9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, | |
11 | 11 | is amended by adding Section 32.077 to read as follows: | |
12 | 12 | Sec. 32.077. PERSONAL NEEDS ALLOWANCE FOR PARTICIPANT IN | |
13 | 13 | HOME AND COMMUNITY-BASED WAIVER PROGRAM. The executive | |
14 | 14 | commissioner shall adopt rules to provide that each participant in | |
15 | 15 | a home and community-based services waiver program is entitled to | |
16 | 16 | receive a personal needs allowance of not less than $85 of the | |
17 | 17 | participant's monthly Supplemental Security Income (SSI) (42 | |
18 | 18 | U.S.C. Section 1381 et seq.). | |
19 | 19 | SECTION 2. If before implementing any provision of this Act | |
20 | 20 | a state agency determines that a waiver or authorization from a | |
21 | 21 | federal agency is necessary for implementation of that provision, | |
22 | 22 | the agency affected by the provision shall request the waiver or | |
23 | 23 | authorization and may delay implementing that provision until the | |
24 | 24 | waiver or authorization is granted. | |
25 | 25 | SECTION 3. This Act takes effect January 1, 2020. |
