57 relating to the maritime port plans, reports, and programs prepared
68 by the Port Authority Advisory Committee.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 55.007(a), Transportation Code, is
911 amended to read as follows:
1012 (a) The committee shall:
1113 (1) prepare the [a] maritime port mission plan
1214 described by Section 55.008;
1315 (2) review each project eligible to be funded under
1416 this chapter and make recommendations for approval or disapproval
1517 to the department; and
1618 (3) [every two years prepare a report on Texas
1719 maritime ports, with a list of projects that have been recommended
1820 by the committee, including:
1921 [(A) the recommended funding level for each
2022 project; and
2123 [(B) if staged implementation of the project is
2224 appropriate, the funding requirements for each stage; and
2325 [(4)] advise the commission and the department on
2426 matters relating to port authorities.
2527 SECTION 2. Section 55.008, Transportation Code, is amended
2628 to read as follows:
2729 Sec. 55.008. MARITIME PORT MISSION PLAN [CAPITAL PROGRAM].
2830 (a) The committee shall prepare a two-year maritime port mission
2931 plan [capital program] defining the goals and objectives of the
3032 committee concerning the development of maritime port facilities
3133 and an intermodal transportation system. The plan [port capital
3234 program] must include projects or studies submitted to the
3335 committee by any maritime port and recommendations for:
3436 (1) the construction of transportation facilities
3537 connecting any maritime port to another transportation mode; and
3638 (2) the efficient, cost-effective development of
3739 transportation facilities or maritime port facilities for the
3840 purpose of:
3941 (A) enhancing international trade;
4042 (B) enhancing security;
4143 (C) promoting cargo flow;
4244 (D) increasing cruise passenger movements;
4345 (E) increasing maritime port revenues; and
4446 (F) providing economic benefits to the state.
4547 (b) The committee shall update the maritime port mission
4648 plan [capital program] and shall submit the updated plan [capital
4749 program] not later than December 1 of each even-numbered year to:
4850 (1) the governor;
4951 (2) the lieutenant governor;
5052 (3) the speaker of the house of representatives; and
5153 (4) the commission.
5254 SECTION 3. Section 55.007(b), Transportation Code, is
5355 repealed.
5456 SECTION 4. This Act takes effect immediately if it receives
5557 a vote of two-thirds of all the members elected to each house, as
5658 provided by Section 39, Article III, Texas Constitution. If this
5759 Act does not receive the vote necessary for immediate effect, this
5860 Act takes effect September 1, 2019.
