7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 55.007(a), Transportation Code, is |
---|
9 | 11 | | amended to read as follows: |
---|
10 | 12 | | (a) The committee shall: |
---|
11 | 13 | | (1) prepare the [a] maritime port mission plan |
---|
12 | 14 | | described by Section 55.008; |
---|
13 | 15 | | (2) review each project eligible to be funded under |
---|
14 | 16 | | this chapter and make recommendations for approval or disapproval |
---|
15 | 17 | | to the department; and |
---|
16 | 18 | | (3) [every two years prepare a report on Texas |
---|
17 | 19 | | maritime ports, with a list of projects that have been recommended |
---|
18 | 20 | | by the committee, including: |
---|
19 | 21 | | [(A) the recommended funding level for each |
---|
20 | 22 | | project; and |
---|
21 | 23 | | [(B) if staged implementation of the project is |
---|
22 | 24 | | appropriate, the funding requirements for each stage; and |
---|
23 | 25 | | [(4)] advise the commission and the department on |
---|
24 | 26 | | matters relating to port authorities. |
---|
25 | 27 | | SECTION 2. Section 55.008, Transportation Code, is amended |
---|
26 | 28 | | to read as follows: |
---|
27 | 29 | | Sec. 55.008. MARITIME PORT MISSION PLAN [CAPITAL PROGRAM]. |
---|
28 | 30 | | (a) The committee shall prepare a two-year maritime port mission |
---|
29 | 31 | | plan [capital program] defining the goals and objectives of the |
---|
30 | 32 | | committee concerning the development of maritime port facilities |
---|
31 | 33 | | and an intermodal transportation system. The plan [port capital |
---|
32 | 34 | | program] must include projects or studies submitted to the |
---|
33 | 35 | | committee by any maritime port and recommendations for: |
---|
34 | 36 | | (1) the construction of transportation facilities |
---|
35 | 37 | | connecting any maritime port to another transportation mode; and |
---|
36 | 38 | | (2) the efficient, cost-effective development of |
---|
37 | 39 | | transportation facilities or maritime port facilities for the |
---|
38 | 40 | | purpose of: |
---|
39 | 41 | | (A) enhancing international trade; |
---|
40 | 42 | | (B) enhancing security; |
---|
41 | 43 | | (C) promoting cargo flow; |
---|
42 | 44 | | (D) increasing cruise passenger movements; |
---|
43 | 45 | | (E) increasing maritime port revenues; and |
---|
44 | 46 | | (F) providing economic benefits to the state. |
---|
45 | 47 | | (b) The committee shall update the maritime port mission |
---|
46 | 48 | | plan [capital program] and shall submit the updated plan [capital |
---|
47 | 49 | | program] not later than December 1 of each even-numbered year to: |
---|
48 | 50 | | (1) the governor; |
---|
49 | 51 | | (2) the lieutenant governor; |
---|
50 | 52 | | (3) the speaker of the house of representatives; and |
---|
51 | 53 | | (4) the commission. |
---|
52 | 54 | | SECTION 3. Section 55.007(b), Transportation Code, is |
---|
53 | 55 | | repealed. |
---|
54 | 56 | | SECTION 4. This Act takes effect immediately if it receives |
---|
55 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 60 | | Act takes effect September 1, 2019. |
