| 7 | 7 | | relating to the issuance of a driver's license, personal |

| 8 | 8 | | identification certificate, or birth record to a homeless |
|---|
| 9 | 9 | | individual. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 191, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 191.0049 to read as follows: |
|---|
| 13 | 13 | | Sec. 191.0049. BIRTH RECORD ISSUED TO HOMELESS INDIVIDUAL. |
|---|
| 14 | 14 | | (a) In this section, "homeless individual" has the meaning |
|---|
| 15 | 15 | | provided by Section 521.184, Transportation Code. |
|---|
| 16 | 16 | | (b) On request of a homeless individual, the state |
|---|
| 17 | 17 | | registrar, a local registrar, or a county clerk shall issue, |
|---|
| 18 | 18 | | without fee, a certified copy of the individual's birth record to |
|---|
| 19 | 19 | | the individual. |
|---|
| 20 | 20 | | (c) The department by rule shall: |
|---|
| 21 | 21 | | (1) adopt a process to verify a person's status as a |
|---|
| 22 | 22 | | homeless individual; and |
|---|
| 23 | 23 | | (2) prescribe the documentation necessary for the |
|---|
| 24 | 24 | | issuance of a certified copy of a birth record to a homeless |
|---|
| 25 | 25 | | individual. |
|---|
| 26 | 26 | | (d) Notwithstanding any other law of this state, the |
|---|
| 27 | 27 | | department may not require a homeless individual to provide a |
|---|
| 28 | 28 | | physical address of the individual's residence to satisfy any |
|---|
| 29 | 29 | | requirement of this section. |
|---|
| 30 | 30 | | SECTION 2. Subchapter I, Chapter 521, Transportation Code, |
|---|
| 31 | 31 | | is amended by adding Section 521.184 to read as follows: |
|---|
| 32 | 32 | | Sec. 521.184. ISSUANCE OF LICENSE OR CERTIFICATE TO |
|---|
| 33 | 33 | | HOMELESS INDIVIDUAL. (a) In this section, "homeless individual": |
|---|
| 34 | 34 | | (1) means an individual who: |
|---|
| 35 | 35 | | (A) lacks a fixed, regular, and adequate |
|---|
| 36 | 36 | | nighttime residence; or |
|---|
| 37 | 37 | | (B) has a primary nighttime residence that is: |
|---|
| 38 | 38 | | (i) a supervised publicly or privately |
|---|
| 39 | 39 | | operated shelter designed to provide temporary living |
|---|
| 40 | 40 | | accommodations, including welfare hotels, congregate shelters, and |
|---|
| 41 | 41 | | transitional housing for the mentally ill; |
|---|
| 42 | 42 | | (ii) an institution that provides a |
|---|
| 43 | 43 | | temporary residence for individuals intended to be |
|---|
| 44 | 44 | | institutionalized; or |
|---|
| 45 | 45 | | (iii) a public or private place not |
|---|
| 46 | 46 | | designed for, or ordinarily used as, a regular sleeping |
|---|
| 47 | 47 | | accommodation for human beings; and |
|---|
| 48 | 48 | | (2) does not include an individual who is imprisoned |
|---|
| 49 | 49 | | or otherwise detained in a correctional facility. |
|---|
| 50 | 50 | | (b) The department by rule shall: |
|---|
| 51 | 51 | | (1) adopt a process to verify a person's status as a |
|---|
| 52 | 52 | | homeless individual; |
|---|
| 53 | 53 | | (2) prescribe the documentation necessary for the |
|---|
| 54 | 54 | | issuance of a driver's license or personal identification |
|---|
| 55 | 55 | | certificate to a homeless individual; and |
|---|
| 56 | 56 | | (3) exempt a homeless individual from the payment of |
|---|
| 57 | 57 | | fees under this chapter for the issuance of a driver's license or |
|---|
| 58 | 58 | | personal identification certificate. |
|---|
| 59 | 59 | | (c) For each fee exemption granted by the department under |
|---|
| 60 | 60 | | Subsection (b)(3), the department shall deposit to the credit of |
|---|
| 61 | 61 | | the Texas mobility fund the amount of the waived fee that would |
|---|
| 62 | 62 | | otherwise be deposited to that account. |
|---|
| 63 | 63 | | (d) Notwithstanding any other law of this state and to the |
|---|
| 64 | 64 | | extent permitted under federal law, the department may not require |
|---|
| 65 | 65 | | a homeless individual to provide a physical address of the |
|---|
| 66 | 66 | | individual's residence to satisfy any requirement of this chapter. |
|---|
| 67 | 67 | | SECTION 3. The changes in law made by this Act apply to an |
|---|
| 68 | 68 | | application for a driver's license, personal identification |
|---|
| 69 | 69 | | certificate, or birth record submitted on or after the effective |
|---|
| 70 | 70 | | date of this Act. An application for a driver's license, personal |
|---|
| 71 | 71 | | identification certificate, or birth record submitted before the |
|---|
| 72 | 72 | | effective date of this Act is governed by the law in effect on the |
|---|
| 73 | 73 | | date the application was submitted, and the former law is continued |
|---|
| 74 | 74 | | in effect for that purpose. |
|---|
| 75 | 75 | | SECTION 4. This Act takes effect September 1, 2019. |
