66 AN ACT
77 relating to the issuance of a driver's license, personal
88 identification certificate, or birth record to a homeless
99 individual.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1212 Code, is amended by adding Section 191.0049 to read as follows:
1313 Sec. 191.0049. BIRTH RECORD ISSUED TO HOMELESS INDIVIDUAL.
1414 (a) In this section, "homeless individual" has the meaning
1515 provided by Section 521.184, Transportation Code.
1616 (b) On request of a homeless individual, the state
1717 registrar, a local registrar, or a county clerk shall issue,
1818 without fee, a certified copy of the individual's birth record to
1919 the individual.
2020 (c) The department by rule shall:
2121 (1) adopt a process to verify a person's status as a
2222 homeless individual; and
2323 (2) prescribe the documentation necessary for the
2424 issuance of a certified copy of a birth record to a homeless
2525 individual.
2626 (d) Notwithstanding any other law of this state, the
2727 department may not require a homeless individual to provide a
2828 physical address of the individual's residence to satisfy any
2929 requirement of this section.
3030 SECTION 2. Subchapter I, Chapter 521, Transportation Code,
3131 is amended by adding Section 521.184 to read as follows:
3232 Sec. 521.184. ISSUANCE OF LICENSE OR CERTIFICATE TO
3333 HOMELESS INDIVIDUAL. (a) In this section, "homeless individual":
3434 (1) means an individual who:
3535 (A) lacks a fixed, regular, and adequate
3636 nighttime residence; or
3737 (B) has a primary nighttime residence that is:
3838 (i) a supervised publicly or privately
3939 operated shelter designed to provide temporary living
4040 accommodations, including welfare hotels, congregate shelters, and
4141 transitional housing for the mentally ill;
4242 (ii) an institution that provides a
4343 temporary residence for individuals intended to be
4444 institutionalized; or
4545 (iii) a public or private place not
4646 designed for, or ordinarily used as, a regular sleeping
4747 accommodation for human beings; and
4848 (2) does not include an individual who is imprisoned
4949 or otherwise detained in a correctional facility.
5050 (b) The department by rule shall:
5151 (1) adopt a process to verify a person's status as a
5252 homeless individual;
5353 (2) prescribe the documentation necessary for the
5454 issuance of a driver's license or personal identification
5555 certificate to a homeless individual; and
5656 (3) exempt a homeless individual from the payment of
5757 fees under this chapter for the issuance of a driver's license or
5858 personal identification certificate.
5959 (c) For each fee exemption granted by the department under
6060 Subsection (b)(3), the department shall deposit to the credit of
6161 the Texas mobility fund the amount of the waived fee that would
6262 otherwise be deposited to that account.
6363 (d) Notwithstanding any other law of this state and to the
6464 extent permitted under federal law, the department may not require
6565 a homeless individual to provide a physical address of the
6666 individual's residence to satisfy any requirement of this chapter.
6767 SECTION 3. The changes in law made by this Act apply to an
6868 application for a driver's license, personal identification
6969 certificate, or birth record submitted on or after the effective
7070 date of this Act. An application for a driver's license, personal
7171 identification certificate, or birth record submitted before the
7272 effective date of this Act is governed by the law in effect on the
7373 date the application was submitted, and the former law is continued
7474 in effect for that purpose.
7575 SECTION 4. This Act takes effect September 1, 2019.
