| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 25.0023, Government Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) Subject to Subsection (a-1), the [The] commissioners |
|---|
| 13 | 13 | | court shall set the annual salary of each judge of a statutory |
|---|
| 14 | 14 | | probate court at an amount that is at least equal to the total |
|---|
| 15 | 15 | | annual salary received by a district judge in the county. A |
|---|
| 16 | 16 | | district judge's or statutory probate court judge's total annual |
|---|
| 17 | 17 | | salary includes contributions and supplements paid by the state or |
|---|
| 18 | 18 | | a county, other than contributions received as compensation under |
|---|
| 19 | 19 | | Section 25.0022(e). |

| 20 | 20 | | (a-1) A judge of a statutory probate court is entitled to an |
|---|
| 21 | 21 | | annual salary, not including contributions and supplements paid by |
|---|
| 22 | 22 | | the state or county, in the amount that is equal to the salary to |
|---|
| 23 | 23 | | which a district judge with the same number of years of service |
|---|
| 24 | 24 | | credit in the Judicial Retirement System of Texas Plan One or the |
|---|
| 25 | 25 | | Judicial Retirement System of Texas Plan Two is entitled under |
|---|
| 26 | 26 | | Section 659.012(b). |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act applies |
|---|
| 28 | 28 | | beginning with the first pay period that begins on or after the |
|---|
| 29 | 29 | | effective date of this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2019, but only |
|---|
| 31 | 31 | | if S.B. 387, Acts of the 86th Legislature, Regular Session, 2019, |
|---|
| 32 | 32 | | or similar legislation becomes law. If that bill or similar |
|---|
| 33 | 33 | | legislation does not become law, this Act has no effect. |
