55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the annual salary of a statutory probate judge.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 25.0023, Government Code, is amended by
1010 amending Subsection (a) and adding Subsection (a-1) to read as
1111 follows:
1212 (a) Subject to Subsection (a-1), the [The] commissioners
1313 court shall set the annual salary of each judge of a statutory
1414 probate court at an amount that is at least equal to the total
1515 annual salary received by a district judge in the county. A
1616 district judge's or statutory probate court judge's total annual
1717 salary includes contributions and supplements paid by the state or
1818 a county, other than contributions received as compensation under
1919 Section 25.0022(e).
2020 (a-1) A judge of a statutory probate court is entitled to an
2121 annual salary, not including contributions and supplements paid by
2222 the state or county, in the amount that is equal to the salary to
2323 which a district judge with the same number of years of service
2424 credit in the Judicial Retirement System of Texas Plan One or the
2525 Judicial Retirement System of Texas Plan Two is entitled under
2626 Section 659.012(b).
2727 SECTION 2. The change in law made by this Act applies
2828 beginning with the first pay period that begins on or after the
2929 effective date of this Act.
3030 SECTION 3. This Act takes effect September 1, 2019, but only
3131 if S.B. 387, Acts of the 86th Legislature, Regular Session, 2019,
3232 or similar legislation becomes law. If that bill or similar
3333 legislation does not become law, this Act has no effect.
