8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter B, Chapter 8, is amended by adding |
---|
10 | 10 | | Section 8.063 to read as follows: |
---|
11 | 11 | | Sec. 8.063. REGIONAL EDUCATION SERVICE CENTER INTERVENTION |
---|
12 | 12 | | TEAM AND PROGRAM. (a) Each regional education service center may |
---|
13 | 13 | | create an intervention team composed of seven members as follows: |
---|
14 | 14 | | (1) the executive director of the regional education |
---|
15 | 15 | | service center; and |
---|
16 | 16 | | (2) the six superintendents employed by school |
---|
17 | 17 | | districts with the highest performance ratings in the area served |
---|
18 | 18 | | by the regional education service center. |
---|
19 | 19 | | (b) Each regional education service center intervention |
---|
20 | 20 | | team created under (a) shall develop an alternative intervention |
---|
21 | 21 | | program for districts and campuses in the area served by the |
---|
22 | 22 | | regional education service center that are subject to Chapter 39A |
---|
23 | 23 | | interventions and sanctions. |
---|
24 | 24 | | (c) Each regional education service center that has created |
---|
25 | 25 | | an intervention team and developed an alternative intervention |
---|
26 | 26 | | program shall submit a written report to the commissioner |
---|
27 | 27 | | identifying the intervention team members and the components of the |
---|
28 | 28 | | alternative intervention program. |
---|
29 | 29 | | SECTION 2. Subchapter A, Chapter 39A, Education Code, is |
---|
30 | 30 | | amended by adding Section 39A.008 to read as follows: |
---|
31 | 31 | | Sec. 39A.008. OPTIONAL ALTERNATIVE INTERVENTION. (a) |
---|
32 | 32 | | Prior to the closure of a campus or the appointment of a board of |
---|
33 | 33 | | managers for a school district or campus under this chapter, the |
---|
34 | 34 | | commissioner may, in the alternative, place the campus or school |
---|
35 | 35 | | district under the oversight of a regional education service center |
---|
36 | 36 | | intervention team for the implementation of intervention measures |
---|
37 | 37 | | as provided under the program developed by the team under Section |
---|
38 | 38 | | 8.063. |
---|
39 | 39 | | (b) If the commissioner makes an election under (a) and a |
---|
40 | 40 | | campus or school district receives an unacceptable performance |
---|
41 | 41 | | rating for two consecutive school years after such election, the |
---|
42 | 42 | | commissioner shall order: |
---|
43 | 43 | | (1) appointment of a board of managers to govern the |
---|
44 | 44 | | district or campus as provided by Subchapter E; or |
---|
45 | 45 | | (2) closure of the campus. |
---|
46 | 46 | | SECTION 3. Section 39A.008, Education Code, as added by |
---|
47 | 47 | | this Act, applies only to a school district that is subject to an |
---|
48 | 48 | | intervention or sanction on or after the effective date of this Act. |
---|
49 | 49 | | A school district subject to an intervention or sanction before the |
---|
50 | 50 | | effective date of this Act is governed by the law as it existed |
---|
51 | 51 | | immediately before the effective date of this Act, and that law is |
---|
52 | 52 | | continued in effect for that purpose. |
---|
53 | 53 | | SECTION 4. This Act takes effect September 1, 2019. |
