55 AN ACT
66 relating to alternative public school accountability

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 8, is amended by adding
1010 Section 8.063 to read as follows:
1111 Sec. 8.063. REGIONAL EDUCATION SERVICE CENTER INTERVENTION
1212 TEAM AND PROGRAM. (a) Each regional education service center may
1313 create an intervention team composed of seven members as follows:
1414 (1) the executive director of the regional education
1515 service center; and
1616 (2) the six superintendents employed by school
1717 districts with the highest performance ratings in the area served
1818 by the regional education service center.
1919 (b) Each regional education service center intervention
2020 team created under (a) shall develop an alternative intervention
2121 program for districts and campuses in the area served by the
2222 regional education service center that are subject to Chapter 39A
2323 interventions and sanctions.
2424 (c) Each regional education service center that has created
2525 an intervention team and developed an alternative intervention
2626 program shall submit a written report to the commissioner
2727 identifying the intervention team members and the components of the
2828 alternative intervention program.
2929 SECTION 2. Subchapter A, Chapter 39A, Education Code, is
3030 amended by adding Section 39A.008 to read as follows:
3131 Sec. 39A.008. OPTIONAL ALTERNATIVE INTERVENTION. (a)
3232 Prior to the closure of a campus or the appointment of a board of
3333 managers for a school district or campus under this chapter, the
3434 commissioner may, in the alternative, place the campus or school
3535 district under the oversight of a regional education service center
3636 intervention team for the implementation of intervention measures
3737 as provided under the program developed by the team under Section
3838 8.063.
3939 (b) If the commissioner makes an election under (a) and a
4040 campus or school district receives an unacceptable performance
4141 rating for two consecutive school years after such election, the
4242 commissioner shall order:
4343 (1) appointment of a board of managers to govern the
4444 district or campus as provided by Subchapter E; or
4545 (2) closure of the campus.
4646 SECTION 3. Section 39A.008, Education Code, as added by
4747 this Act, applies only to a school district that is subject to an
4848 intervention or sanction on or after the effective date of this Act.
4949 A school district subject to an intervention or sanction before the
5050 effective date of this Act is governed by the law as it existed
5151 immediately before the effective date of this Act, and that law is
5252 continued in effect for that purpose.
5353 SECTION 4. This Act takes effect September 1, 2019.
