6	6	AN ACT
7	7	relating to the deposit and distribution by the Texas Racing
8	8	Commission of certain pari-mutuel wagering funds to benefit the
9	9	Texas-bred program.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 2023.053, Occupations Code, is amended
12	12	by adding Subsection (f) to read as follows:
13	13	(f) This section does not apply to money deposited into the
14	14	Texas-bred incentive fund established under Section 2028.301.
15	15	SECTION 2. Section 2024.055, Occupations Code, is amended
16	16	to read as follows:
17	17	Sec. 2024.055. DEPOSIT OF STATE'S SHARE. (a) The
18	18	comptroller shall deposit the state's share of each pari-mutuel
19	19	pool from horse racing and greyhound racing in the general revenue
20	20	fund.
21	21	(b) This section does not apply to money deposited into the
22	22	Texas-bred incentive fund established under Section 2028.301.
23	23	SECTION 3. Section 2028.103, Occupations Code, is amended
24	24	by amending Subsections (a) and (c) and adding Subsection (a-1) to
25	25	read as follows:
26	26	(a) A horse racetrack association shall set aside for the
27	27	Texas-bred program and pay to the commission an amount equal to one
28	28	percent of a live multiple two wagering pool and a live multiple
29	29	three wagering pool. From the set-aside amounts:
30	30	(1) two percent shall be set aside for purposes of
31	31	Subchapter F, Chapter 88, Education Code; and
32	32	(2) the remaining amount shall be allocated as
33	33	follows:
34	34	(A) 10 percent may be used by the appropriate
35	35	state horse breed registry for administration; and
36	36	(B) the remainder shall be used for awards.
37	37	(a-1) The commission shall deposit money paid to the
38	38	commission under Subsection (a) into the Texas-bred incentive fund
39	39	established under Section 2028.301. The commission shall
40	40	distribute the money collected under this section and deposited
41	41	into the fund to the appropriate state horse breed registries for
42	42	the Texas-bred program in accordance with rules adopted under
43	43	Subsection (c).
44	44	(c) The commission shall adopt rules relating to the
45	45	deposit, accounting, auditing, and distribution of all amounts set
46	46	aside for the Texas-bred program under this subchapter and for the
47	47	use of those amounts by the state breed registries under that
48	48	program.
49	49	SECTION 4. Section 2028.105, Occupations Code, is amended
50	50	by amending Subsection (d) and adding Subsection (d-1) to read as
51	51	follows:
52	52	(d) The horse racetrack association shall pay to the
53	53	commission for deposit into the Texas-bred incentive fund
54	54	established under Section 2028.301 and distribution to the
55	55	appropriate state horse breed registry [shall pay] the remaining 80
56	56	percent of the total breakage to be allocated as follows:
57	57	(1) 40 percent to the owners of the accredited
58	58	Texas-bred horses that finish first, second, or third;
59	59	(2) 40 percent to the breeders of accredited
60	60	Texas-bred horses that finish first, second, or third; and
61	61	(3) 20 percent to the owner of the stallion standing in
62	62	this state at the time of conception whose Texas-bred get finish
63	63	first, second, or third.
64	64	(d-1) The commission shall deposit the portions of total
65	65	breakage paid to the commission under Subsections (b) and (d) into
66	66	the Texas-bred incentive fund established under Section 2028.301.
67	67	The commission shall distribute the money collected under this
68	68	section and deposited into the fund to the appropriate state horse
69	69	breed registries in accordance with this section and with rules
70	70	adopted by the commission under Section 2028.103.
71	71	SECTION 5. Section 2028.154(a), Occupations Code, is
72	72	amended to read as follows:
73	73	(a) A greyhound racetrack association shall pay 50 percent
74	74	of the breakage to the appropriate state greyhound breed registry.
75	75	Of that breakage percentage:
76	76	(1) 25 percent is to be used in stakes races; and
77	77	(2) 25 percent of that total breakage from a live
78	78	pari-mutuel pool or a simulcast pari-mutuel pool is to be paid to
79	79	the commission for deposit into the Texas-bred incentive fund
80	80	established under Section 2028.301. The commission shall
81	81	distribute the money collected under this section and deposited
82	82	into the fund to [use by] the state greyhound breed registry for use
83	83	in accordance with this section and[, subject to] commission rules.
84	84	SECTION 6. Section 2028.202, Occupations Code, is amended
85	85	by adding Subsection (a-1) to read as follows:
86	86	(a-1) A racetrack association shall pay to the commission
87	87	for deposit into the Texas-bred incentive fund established under
88	88	Section 2028.301 the shares to be distributed under Subsections
89	89	(a)(3) and (a)(4) for the Texas-bred program. The commission shall
90	90	distribute the money collected under this section and deposited
91	91	into the fund to the appropriate state breed registries for use
92	92	under the Texas-bred program.
93	93	SECTION 7. Chapter 2028, Occupations Code, is amended by
94	94	adding Subchapter G to read as follows:
95	95	SUBCHAPTER G. TEXAS-BRED INCENTIVE FUND
96	96	Sec. 2028.301. TEXAS-BRED INCENTIVE FUND. (a) The
97	97	commission shall deposit money set aside for the Texas-bred program
98	98	or set aside for use by state breed registries under this chapter
99	99	into an escrow account in the state treasury in the registry of the
100	100	commission to be known as the Texas-bred incentive fund.
101	101	(b) The commission shall distribute money from the
102	102	Texas-bred incentive fund in accordance with this chapter and
103	103	commission rules.
104	104	SECTION 8. (a) The changes in law made by this Act apply to
105	105	the deductions and breakage from a wagering pool for a horse or
106	106	greyhound race conducted by a racetrack association on or after the
107	107	effective date of this Act.
108	108	(b) As soon as practicable after the effective date of this
109	109	Act, the Texas Racing Commission shall revise existing rules or
110	110	adopt new rules as necessary to comply with this Act.
111	111	SECTION 9. This Act takes effect September 1, 2019.
