6	6	AN ACT
7	7	relating to voluntary contributions to the cancer prevention and
8	8	research fund for pediatric cancer research.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. This Act shall be known as the Jonny Wade Act.
11	11	SECTION 2. Subchapter G, Chapter 501, Transportation Code,
12	12	is amended by adding Section 501.140 to read as follows:
13	13	Sec. 501.140. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
14	14	RESEARCH. (a) When a person applies for title of a motor vehicle
15	15	under this chapter, the person may contribute any amount to the
16	16	cancer prevention and research fund established by Section 102.201,
17	17	Health and Safety Code, to fund pediatric cancer research.
18	18	(b) The department shall provide, in a conspicuous manner,
19	19	an opportunity for the person to contribute to the fund at the time
20	20	a person applies for title under this chapter.
21	21	(c) The county assessor-collector shall send any
22	22	contribution made under this section to the comptroller for deposit
23	23	to the cancer prevention and research fund established by Section
24	24	102.201, Health and Safety Code, before the 35th day after the date
25	25	the contribution is made.
26	26	(d) Money deposited under Subsection (c) may be used only to
27	27	fund pediatric cancer research.
28	28	SECTION 3. Subchapter H, Chapter 502, Transportation Code,
29	29	is amended by adding Section 502.416 to read as follows:
30	30	Sec. 502.416. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
31	31	RESEARCH. (a) When a person registers or renews the registration
32	32	of a motor vehicle under this chapter, the person may contribute any
33	33	amount to the cancer prevention and research fund established by
34	34	Section 102.201, Health and Safety Code, to fund pediatric cancer
35	35	research.
36	36	(b) The department shall provide, in a conspicuous manner,
37	37	an opportunity for the person to contribute to the fund in any
38	38	registration renewal system used by the department.
39	39	(c) If a person makes a contribution under this section and
40	40	does not pay the full amount of a registration fee, the county
41	41	assessor-collector may credit all or a portion of the contribution
42	42	to the person's registration fee.
43	43	(d) The county assessor-collector shall send any
44	44	contribution made under this section to the comptroller for deposit
45	45	to the cancer prevention and research fund established by Section
46	46	102.201, Health and Safety Code, before the 31st day after the date
47	47	the contribution is made.
48	48	(e) Money deposited under Subsection (d) may be used only to
49	49	fund pediatric cancer research.
50	50	SECTION 4. Subchapter G, Chapter 504, Transportation Code,
51	51	is amended by adding Section 504.6013 to read as follows:
52	52	Sec. 504.6013. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
53	53	RESEARCH. (a) When a person applies for a specialty license plate
54	54	under this subchapter, the person may contribute any amount to the
55	55	cancer prevention and research fund established by Section 102.201,
56	56	Health and Safety Code, to fund pediatric cancer research.
57	57	(b) The department or the private vendor authorized under
58	58	Subchapter J, as applicable, shall provide, in a conspicuous
59	59	manner, an opportunity for the person to contribute to the fund at
60	60	the time the person applies for a specialty license plate under this
61	61	subchapter.
62	62	(c) The department or the private vendor authorized under
63	63	Subchapter J, as applicable, shall send any contribution made under
64	64	this section to the comptroller for deposit to the cancer
65	65	prevention and research fund established by Section 102.201, Health
66	66	and Safety Code, before the 31st day after the date the contribution
67	67	is made.
68	68	(d) Money deposited under Subsection (c) may be used only to
69	69	fund pediatric cancer research.
70	70	SECTION 5. Subchapter A, Chapter 521, Transportation Code,
71	71	is amended by adding Section 521.013 to read as follows:
72	72	Sec. 521.013. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
73	73	RESEARCH. (a) When a person applies for an original or renewal
74	74	driver's license or personal identification certificate under this
75	75	chapter, the person may contribute any amount to the cancer
76	76	prevention and research fund established by Section 102.201, Health
77	77	and Safety Code, to fund pediatric cancer research.
78	78	(b) The department shall:
79	79	(1) include space on the first page of each
80	80	application for an original or renewal driver's license or personal
81	81	identification certificate that allows a person applying for an
82	82	original or renewal driver's license or personal identification
83	83	certificate to indicate the amount that the person is voluntarily
84	84	contributing to the fund; and
85	85	(2) provide an opportunity for the person to
86	86	contribute to the fund during the application process for an
87	87	original or renewal driver's license or personal identification
88	88	certificate on the department's Internet website.
89	89	(c) The department shall send any contribution made under
90	90	this section to the comptroller for deposit to the credit of the
91	91	cancer prevention and research fund established by Section 102.201,
92	92	Health and Safety Code, not later than the 14th day of each month.
93	93	(d) Money deposited under Subsection (c) may be used only to
94	94	fund pediatric cancer research.
95	95	SECTION 6. This Act takes effect September 1, 2019.
