66 AN ACT
77 relating to voluntary contributions to the cancer prevention and
88 research fund for pediatric cancer research.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act shall be known as the Jonny Wade Act.
1111 SECTION 2. Subchapter G, Chapter 501, Transportation Code,
1212 is amended by adding Section 501.140 to read as follows:
1313 Sec. 501.140. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
1414 RESEARCH. (a) When a person applies for title of a motor vehicle
1515 under this chapter, the person may contribute any amount to the
1616 cancer prevention and research fund established by Section 102.201,
1717 Health and Safety Code, to fund pediatric cancer research.
1818 (b) The department shall provide, in a conspicuous manner,
1919 an opportunity for the person to contribute to the fund at the time
2020 a person applies for title under this chapter.
2121 (c) The county assessor-collector shall send any
2222 contribution made under this section to the comptroller for deposit
2323 to the cancer prevention and research fund established by Section
2424 102.201, Health and Safety Code, before the 35th day after the date
2525 the contribution is made.
2626 (d) Money deposited under Subsection (c) may be used only to
2727 fund pediatric cancer research.
2828 SECTION 3. Subchapter H, Chapter 502, Transportation Code,
2929 is amended by adding Section 502.416 to read as follows:
3030 Sec. 502.416. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
3131 RESEARCH. (a) When a person registers or renews the registration
3232 of a motor vehicle under this chapter, the person may contribute any
3333 amount to the cancer prevention and research fund established by
3434 Section 102.201, Health and Safety Code, to fund pediatric cancer
3535 research.
3636 (b) The department shall provide, in a conspicuous manner,
3737 an opportunity for the person to contribute to the fund in any
3838 registration renewal system used by the department.
3939 (c) If a person makes a contribution under this section and
4040 does not pay the full amount of a registration fee, the county
4141 assessor-collector may credit all or a portion of the contribution
4242 to the person's registration fee.
4343 (d) The county assessor-collector shall send any
4444 contribution made under this section to the comptroller for deposit
4545 to the cancer prevention and research fund established by Section
4646 102.201, Health and Safety Code, before the 31st day after the date
4747 the contribution is made.
4848 (e) Money deposited under Subsection (d) may be used only to
4949 fund pediatric cancer research.
5050 SECTION 4. Subchapter G, Chapter 504, Transportation Code,
5151 is amended by adding Section 504.6013 to read as follows:
5252 Sec. 504.6013. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
5353 RESEARCH. (a) When a person applies for a specialty license plate
5454 under this subchapter, the person may contribute any amount to the
5555 cancer prevention and research fund established by Section 102.201,
5656 Health and Safety Code, to fund pediatric cancer research.
5757 (b) The department or the private vendor authorized under
5858 Subchapter J, as applicable, shall provide, in a conspicuous
5959 manner, an opportunity for the person to contribute to the fund at
6060 the time the person applies for a specialty license plate under this
6161 subchapter.
6262 (c) The department or the private vendor authorized under
6363 Subchapter J, as applicable, shall send any contribution made under
6464 this section to the comptroller for deposit to the cancer
6565 prevention and research fund established by Section 102.201, Health
6666 and Safety Code, before the 31st day after the date the contribution
6767 is made.
6868 (d) Money deposited under Subsection (c) may be used only to
6969 fund pediatric cancer research.
7070 SECTION 5. Subchapter A, Chapter 521, Transportation Code,
7171 is amended by adding Section 521.013 to read as follows:
7272 Sec. 521.013. VOLUNTARY CONTRIBUTION FOR PEDIATRIC CANCER
7373 RESEARCH. (a) When a person applies for an original or renewal
7474 driver's license or personal identification certificate under this
7575 chapter, the person may contribute any amount to the cancer
7676 prevention and research fund established by Section 102.201, Health
7777 and Safety Code, to fund pediatric cancer research.
7878 (b) The department shall:
7979 (1) include space on the first page of each
8080 application for an original or renewal driver's license or personal
8181 identification certificate that allows a person applying for an
8282 original or renewal driver's license or personal identification
8383 certificate to indicate the amount that the person is voluntarily
8484 contributing to the fund; and
8585 (2) provide an opportunity for the person to
8686 contribute to the fund during the application process for an
8787 original or renewal driver's license or personal identification
8888 certificate on the department's Internet website.
8989 (c) The department shall send any contribution made under
9090 this section to the comptroller for deposit to the credit of the
9191 cancer prevention and research fund established by Section 102.201,
9292 Health and Safety Code, not later than the 14th day of each month.
9393 (d) Money deposited under Subsection (c) may be used only to
9494 fund pediatric cancer research.
9595 SECTION 6. This Act takes effect September 1, 2019.
