9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 533A.062(b), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) The proposed plan must specify the capacity of the HCS | |
13 | 13 | waiver program for persons with an intellectual disability and the | |
14 | 14 | number and levels of new ICF-IID beds to be authorized in each | |
15 | 15 | region. In developing the proposed plan, the department shall | |
16 | 16 | consider: | |
17 | 17 | (1) the needs of the population and community to be | |
18 | 18 | served; | |
19 | 19 | (2) projected appropriation amounts for the biennium; | |
20 | 20 | and | |
21 | 21 | (3) the requirements of applicable federal law. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2019. |
