44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to developing the proposed plan on long-term care for
77 persons with an intellectual disability participating in the home
88 and community-based waiver program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 533A.062(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) The proposed plan must specify the capacity of the HCS
1313 waiver program for persons with an intellectual disability and the
1414 number and levels of new ICF-IID beds to be authorized in each
1515 region. In developing the proposed plan, the department shall
1616 consider:
1717 (1) the needs of the population and community to be
1818 served;
1919 (2) projected appropriation amounts for the biennium;
2020 and
2121 (3) the requirements of applicable federal law.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2019.
