5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the terms and election of the members of the board of
8	8	directors of the Elm Creek Watershed Authority.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 14, Chapter 273, Acts of the 55th
11	11	Legislature, Regular Session, 1957, is amended to read as follows:
12	12	Sec. 14. (a) The Board of Directors of the Authority is
13	13	composed [shall be comprised] of eight persons who serve staggered,
14	14	four-year terms.
15	15	(b) [Immediately after this Act becomes effective, the
16	16	following named persons shall be the directors of the Authority and
17	17	shall constitute the Board of Directors of said Authority:
18	18	[W. M. Evetts, Route 1, Moody, Texas;
19	19	[David Haggard, Route 4, Oenaville, Texas;
20	20	[J. W. Holmes, Route 2, Rogers, Texas;
21	21	[Buster Griffin, Buckholts, Texas;
22	22	[Jim Reddin, Troy, Texas;
23	23	[Bartle Crenan, Cameron, Texas;
24	24	[Frank Maruna, Temple, Texas; and
25	25	[A. A. Stavinoha, Temple, Texas.
26	26	[The Board of Directors herein appointed shall serve
27	27	until their successors have been duly elected and qualified. The
28	28	first four directors named above shall serve until the second
29	29	Tuesday in January, 1958, and the following four directors shall
30	30	serve until the second Tuesday in January, 1959.] An election for
31	31	directors shall be held on the uniform election date [second
32	32	Tuesday] in November [January] of each odd-numbered year [and as
33	33	herein provided. Four directors shall be elected in each even
34	34	numbered year and four in each odd numbered year].
35	35	(c) The directors of the Authority or of any subordinate
36	36	district shall be landowners within the Authority and reside within
37	37	Bell, Falls, Milam or McLennan Counties, and shall retain such
38	38	status during their tenure in office or vacate such office.
39	39	SECTION 2. (a) A director of the Elm Creek Watershed
40	40	Authority elected in May 2019 shall serve until the director's
41	41	successor has qualified following the directors' election held on
42	42	the uniform election date in November 2023. A director elected on
43	43	the uniform election date in November 2023 serves a four-year term.
44	44	(b) A director of the Elm Creek Watershed Authority elected
45	45	in 2018 shall serve until the director's successor has qualified
46	46	following the directors' election held on the uniform election date
47	47	in November 2021. A director elected to succeed that director
48	48	serves a four-year term.
49	49	(c) This section expires September 1, 2024.
50	50	SECTION 3. (a) The legal notice of the intention to
51	51	introduce this Act, setting forth the general substance of this
52	52	Act, has been published as provided by law, and the notice and a
53	53	copy of this Act have been furnished to all persons, agencies,
54	54	officials, or entities to which they are required to be furnished
55	55	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
56	56	Government Code.
57	57	(b) The governor, one of the required recipients, has
58	58	submitted the notice and Act to the Texas Commission on
59	59	Environmental Quality.
60	60	(c) The Texas Commission on Environmental Quality has filed
61	61	its recommendations relating to this Act with the governor, the
62	62	lieutenant governor, and the speaker of the house of
63	63	representatives within the required time.
64	64	(d) All requirements of the constitution and laws of this
65	65	state and the rules and procedures of the legislature with respect
66	66	to the notice, introduction, and passage of this Act are fulfilled
67	67	and accomplished.
68	68	SECTION 4. This Act takes effect September 1, 2019.
