55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the filing of financial disclosure statements by
88 trustees of certain independent school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.064, Education Code, is amended by
1111 adding Subsection (a-5) and amending Subsection (c) to read as
1212 follows:
1313 (a-5) A member of the board of trustees of an independent
1414 school district with a student enrollment of more than 30,000 is
1515 required to file the financial statement required of state officers
1616 under Subchapter B, Chapter 572, Government Code, in the same
1717 manner as the members of a board of trustees that has adopted a
1818 resolution under Subsection (a).
1919 (c) A trustee required to file the financial statement under
2020 this section [serving in a school district that has adopted a
2121 resolution under Subsection (a) or that is subject to an order
2222 issued under Subsection (a-3)] commits an offense if the trustee
2323 fails to file the statement [required by the resolution or order].
2424 An offense under this section is a Class B misdemeanor.
2525 SECTION 2. Section 11.064(a-5), Education Code, as added by
2626 this Act, applies beginning January 1, 2021, to a trustee who,
2727 before the effective date of this Act, was not required to file a
2828 financial statement under Section 11.064, Education Code, and such
2929 a trustee is not required to include financial activity occurring
3030 before January 1, 2020, in a statement filed under Section 11.064,
3131 Education Code.
3232 SECTION 3. This Act takes effect January 1, 2020.
