54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to the use of information from the lists of noncitizens and
87 nonresidents excused or disqualified from jury service.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 18.068(a), Election Code, is amended to
1110 read as follows:
1211 (a) The secretary of state shall quarterly compare the
1312 information received under Section 16.001 of this code and Sections
1413 [Section] 62.113 and 62.114, Government Code, to the statewide
1514 computerized voter registration list. If the secretary determines
1615 that a voter on the registration list is deceased or has been
1716 excused or disqualified from jury service because the voter is not a
1817 citizen or a resident of the county in which the voter is registered
1918 to vote, the secretary shall send notice of the determination to:
2019 (1) the voter registrar of the counties considered
2120 appropriate by the secretary; and
2221 (2) the attorney general, who shall quarterly review
2322 the information to investigate whether a person has committed an
2423 offense under Section 13.007 or other law.
2524 SECTION 2. Section 62.113(b), Government Code, is amended
2625 to read as follows:
2726 (b) On the third business day of each month, the clerk shall
2827 send a copy of the list of persons excused or disqualified because
2928 of citizenship in the previous month to:
3029 (1) the voter registrar of the county;
3130 (2) the secretary of state; and
3231 (3) the county or district attorney, as applicable, or
3332 the attorney general for an investigation of whether the person
3433 committed an offense under Section 13.007, Election Code, or other
3534 law.
3635 SECTION 3. Sections 62.114(b) and (c), Government Code, are
3736 amended to read as follows:
3837 (b) On the third business day of each month, the clerk shall
3938 send [to the voter registrar of the county] a copy of the list of
4039 persons excused or disqualified in the previous month because the
4140 persons do not reside in the county to:
4241 (1) the voter registrar of the county;
4342 (2) the secretary of state; and
4443 (3) the county or district attorney, as applicable, or
4544 the attorney general for an investigation of whether the person
4645 committed an offense under Section 13.007, Election Code, or other
4746 law.
4847 (c) A list compiled under this section may not be used for a
4948 purpose other than a purpose described by Subsection (b) or Section
5049 15.081 or 18.068, Election Code.
5150 SECTION 4. This Act takes effect immediately if it receives
5251 a vote of two-thirds of all the members elected to each house, as
5352 provided by Section 39, Article III, Texas Constitution. If this
5453 Act does not receive the vote necessary for immediate effect, this
5554 Act takes effect September 1, 2019.
