| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter S, Chapter 61, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 61.8233 to read as follows: |
|---|
| 13 | 13 | | Sec. 61.8233. WAIVER OF TUITION AND FEES FOR COURSES NOT |
|---|
| 14 | 14 | | TRANSFERRED TOWARD DEGREE PROGRAM. Notwithstanding any other |
|---|
| 15 | 15 | | provision, an institution of higher education that admits a student |
|---|
| 16 | 16 | | transferring from another institution of higher education shall |
|---|
| 17 | 17 | | waive the tuition and required fees that would otherwise be imposed |
|---|
| 18 | 18 | | for the student for a number of semester credit hours equal to the |
|---|
| 19 | 19 | | number of semester credit hours earned by the student in the core |
|---|
| 20 | 20 | | curriculum or a field of study curriculum of the sending |
|---|
| 21 | 21 | | institution for which the receiving institution: |
|---|
| 22 | 22 | | (1) does not award the student academic credit toward |
|---|
| 23 | 23 | | the student's degree program; or |
|---|
| 24 | 24 | | (2) awards only elective credit. |
|---|
| 25 | 25 | | SECTION 2. Section 61.827, Education Code, is amended to |
|---|
| 26 | 26 | | read as follows: |
|---|
| 27 | 27 | | Sec. 61.827. RULES. The board is authorized to adopt rules |
|---|
| 28 | 28 | | implementing the provisions of this subchapter, including rules to |
|---|
| 29 | 29 | | ensure compliance with this subchapter. |
|---|
| 30 | 30 | | SECTION 3. This Act applies beginning with the 2019-2020 |
|---|
| 31 | 31 | | academic year. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2019. |
