55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enforcement of certain requirements regarding the
88 transfer of course credit between public institutions of higher
99 education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter S, Chapter 61, Education Code, is
1212 amended by adding Section 61.8233 to read as follows:
1313 Sec. 61.8233. WAIVER OF TUITION AND FEES FOR COURSES NOT
1414 TRANSFERRED TOWARD DEGREE PROGRAM. Notwithstanding any other
1515 provision, an institution of higher education that admits a student
1616 transferring from another institution of higher education shall
1717 waive the tuition and required fees that would otherwise be imposed
1818 for the student for a number of semester credit hours equal to the
1919 number of semester credit hours earned by the student in the core
2020 curriculum or a field of study curriculum of the sending
2121 institution for which the receiving institution:
2222 (1) does not award the student academic credit toward
2323 the student's degree program; or
2424 (2) awards only elective credit.
2525 SECTION 2. Section 61.827, Education Code, is amended to
2626 read as follows:
2727 Sec. 61.827. RULES. The board is authorized to adopt rules
2828 implementing the provisions of this subchapter, including rules to
2929 ensure compliance with this subchapter.
3030 SECTION 3. This Act applies beginning with the 2019-2020
3131 academic year.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2019.
