66 AN ACT
77 relating to the development of a climate adaptation plan by certain
88 entities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 5, Health and Safety Code, is
1111 amended by adding Chapter 396 to read as follows:
1212 CHAPTER 396. CLIMATE ADAPTATION PLAN
1313 Sec. 396.001. PARTICIPATING ENTITIES. Not later than
1414 September 1, 2020, and before the end of each successive four-year
1515 period after that date, each of the following entities shall
1616 publish a climate adaptation plan that will assess the entity's
1717 role with respect to climate change:
1818 (1) the Department of Agriculture;
1919 (2) each independent organization certified under
2020 Section 39.151, Utilities Code;
2121 (3) the Texas Commission on Environmental Quality;
2222 (4) the General Land Office;
2323 (5) the Texas Department of Housing and Community
2424 Affairs;
2525 (6) the Texas Department of Insurance;
2626 (7) the Parks and Wildlife Department;
2727 (8) the Department of Public Safety of the State of
2828 Texas;
2929 (9) the Public Utility Commission of Texas;
3030 (10) the office of the comptroller;
3131 (11) the Texas A&M Forest Service; and
3232 (12) the Texas Water Development Board.
3333 Sec. 396.002. PLAN. (a) For the purposes of this chapter,
3434 a climate adaptation plan is a strategy to identify, minimize, and
3535 adequately prepare for the effects of climate change on the social,
3636 economic, and ecological systems of this state and to manage the
3737 risks associated with a changing climate. A plan under this chapter
3838 must be based on current peer-reviewed climate science that
3939 identifies the likely impacts of rising ambient temperatures,
4040 rising sea levels, and changes in precipitation patterns on this
4141 state.
4242 (b) Each climate adaptation plan must include:
4343 (1) a climate change vulnerability assessment;
4444 (2) a review of existing programs in the context of
4545 anticipated changing climate conditions;
4646 (3) specific steps necessary for the entity to fulfill
4747 its mission during the anticipated climate change;
4848 (4) an analysis of the effects implementing the steps
4949 identified under Subdivision (3) would have on the entity's budget
5050 during the next 5 and 10 years;
5151 (5) potential sources of funding to support the
5252 entity's efforts to adapt to climate change;
5353 (6) a statewide strategy to monitor the continuing
5454 effects that climate change may have on the entity's ability to
5555 fulfill the entity's missions; and
5656 (7) a written statement by the Texas state
5757 climatologist regarding the adequacy of the scientific basis of the
5858 plan.
5959 (c) In developing a climate adaptation plan, each entity
6060 subject to this chapter shall:
6161 (1) consider the most current assessment reports
6262 created by the United States Global Change Research Program; and
6363 (2) consult with the Texas state climatologist or
6464 another climate expert employed at a Texas institution of higher
6565 education or nonprofit research institution.
6666 (d) Not later than September 1, 2020, and before the end of
6767 each successive four-year period after that date, each entity
6868 subject to this chapter shall post the entity's climate adaptation
6969 plan on a publicly accessible Internet website and electronically
7070 submit a copy of the plan to:
7171 (1) the governor, lieutenant governor, and speaker of
7272 the house of representatives;
7373 (2) the presiding officer of each standing committee
7474 or subcommittee of the legislature with primary jurisdiction over
7575 environmental matters; and
7676 (3) the executive director of the Texas Commission on
7777 Environmental Quality.
7878 (e) Each climate adaptation plan is subject to audit by the
7979 state auditor in accordance with Chapter 321, Government Code.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2019.
