9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. Section 361.121(a)(2), Health and Safety Code, |
---|
11 | 10 | | is amended to read as follows: |
---|
12 | 11 | | (2) "Land application unit" means an area where wastes |
---|
13 | 12 | | are applied onto or incorporated into the soil surface for |
---|
14 | 13 | | agricultural purposes or for treatment and disposal. The term does |
---|
15 | 14 | | not include manure spreading operations or placement of waste on a |
---|
16 | 15 | | liner registered or permitted by the commission. |
---|
17 | 16 | | SECTION 2. Subchapter C, Chapter 361, Health and Safety |
---|
18 | 17 | | Code, is amended by adding Section 361.1215 to read as follows: |
---|
19 | 18 | | Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP |
---|
20 | 19 | | WASTE PROHIBITED. (a) In this section: |
---|
21 | 20 | | (1) "Grease trap waste" means a material collected in |
---|
22 | 21 | | and from a grease interceptor in the sanitary sewer line of a |
---|
23 | 22 | | commercial, institutional, or industrial food service or |
---|
24 | 23 | | processing facility. The term includes the solids resulting from a |
---|
25 | 24 | | dewatering process. |
---|
26 | 25 | | (2) "Grit trap" means a unit or chamber that: |
---|
27 | 26 | | (A) allows the sedimentation of solids from an |
---|
28 | 27 | | influent liquid stream by reducing the flow velocity of the stream; |
---|
29 | 28 | | (B) has an inlet and outlet that are both located |
---|
30 | 29 | | at the same vertical level at or near the top of the unit or chamber; |
---|
31 | 30 | | (C) has an outlet that is connected to a sanitary |
---|
32 | 31 | | sewer system; and |
---|
33 | 32 | | (D) is not designed to separate oil and water. |
---|
34 | 33 | | (3) "Grit trap waste" means the waste collected in a |
---|
35 | 34 | | grit trap. The term includes waste from an interceptor placed in a |
---|
36 | 35 | | drain at maintenance and repair shops, automobile service stations, |
---|
37 | 36 | | car washes, laundries, and other similar facilities. |
---|
38 | 37 | | (b) The commission may not issue a permit, registration, or |
---|
39 | 38 | | other authorization for land application of grease trap waste or |
---|
40 | 39 | | grit trap waste, including processed grease trap waste or grit trap |
---|
41 | 40 | | waste, or sewer sludge mixed with grease trap waste or grit trap |
---|
42 | 41 | | waste. |
---|
43 | 42 | | (c) This section does not apply to: |
---|
44 | 43 | | (1) the disposal of grease trap waste or grit trap |
---|
45 | 44 | | waste at a municipal solid waste Type I landfill permitted by the |
---|
46 | 45 | | commission; |
---|
47 | 46 | | (2) the processing of grease trap waste or grit trap |
---|
48 | 47 | | waste at a municipal solid waste Type V compost facility permitted |
---|
49 | 48 | | or registered by the commission; or |
---|
50 | 49 | | (3) land application of Grade 1 or Grade 2 compost |
---|
51 | 50 | | generated at a Type V compost facility permitted to compost grease |
---|
52 | 51 | | trap waste by the commission. |
---|
53 | 52 | | SECTION 3. A permit, registration, or other authorization |
---|
54 | 53 | | issued by the Texas Commission on Environmental Quality that allows |
---|
55 | 54 | | the land application of grease trap waste or grit trap waste expires |
---|
56 | 55 | | on the effective date of this Act. The remainder of a permit, |
---|
57 | 56 | | registration, or other authorization that contains items in |
---|
58 | 57 | | addition to an authorization allowing the land application of |
---|
59 | 58 | | grease trap waste or grit trap waste remains in effect to the extent |
---|
60 | 59 | | that it does not authorize the land application of grease trap waste |
---|
61 | 60 | | or grit trap waste. |
---|
62 | 61 | | SECTION 4. This Act takes effect immediately if it receives |
---|
63 | 62 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 64 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 65 | | Act takes effect September 1, 2019. |
