76 relating to a prohibition of the land application of grease or grit
87 trap waste.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 361.121(a)(2), Health and Safety Code,
1110 is amended to read as follows:
1211 (2) "Land application unit" means an area where wastes
1312 are applied onto or incorporated into the soil surface for
1413 agricultural purposes or for treatment and disposal. The term does
1514 not include manure spreading operations or placement of waste on a
1615 liner registered or permitted by the commission.
1716 SECTION 2. Subchapter C, Chapter 361, Health and Safety
1817 Code, is amended by adding Section 361.1215 to read as follows:
1918 Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
2019 WASTE PROHIBITED. (a) In this section:
2120 (1) "Grease trap waste" means a material collected in
2221 and from a grease interceptor in the sanitary sewer line of a
2322 commercial, institutional, or industrial food service or
2423 processing facility. The term includes the solids resulting from a
2524 dewatering process.
2625 (2) "Grit trap" means a unit or chamber that:
2726 (A) allows the sedimentation of solids from an
2827 influent liquid stream by reducing the flow velocity of the stream;
2928 (B) has an inlet and outlet that are both located
3029 at the same vertical level at or near the top of the unit or chamber;
3130 (C) has an outlet that is connected to a sanitary
3231 sewer system; and
3332 (D) is not designed to separate oil and water.
3433 (3) "Grit trap waste" means the waste collected in a
3534 grit trap. The term includes waste from an interceptor placed in a
3635 drain at maintenance and repair shops, automobile service stations,
3736 car washes, laundries, and other similar facilities.
3837 (b) The commission may not issue a permit, registration, or
3938 other authorization for land application of grease trap waste or
4039 grit trap waste, including processed grease trap waste or grit trap
4140 waste, or sewer sludge mixed with grease trap waste or grit trap
4241 waste.
4342 (c) This section does not apply to:
4443 (1) the disposal of grease trap waste or grit trap
4544 waste at a municipal solid waste Type I landfill permitted by the
4645 commission;
4746 (2) the processing of grease trap waste or grit trap
4847 waste at a municipal solid waste Type V compost facility permitted
4948 or registered by the commission; or
5049 (3) land application of Grade 1 or Grade 2 compost
5150 generated at a Type V compost facility permitted to compost grease
5251 trap waste by the commission.
5352 SECTION 3. A permit, registration, or other authorization
5453 issued by the Texas Commission on Environmental Quality that allows
5554 the land application of grease trap waste or grit trap waste expires
5655 on the effective date of this Act. The remainder of a permit,
5756 registration, or other authorization that contains items in
5857 addition to an authorization allowing the land application of
5958 grease trap waste or grit trap waste remains in effect to the extent
6059 that it does not authorize the land application of grease trap waste
6160 or grit trap waste.
6261 SECTION 4. This Act takes effect immediately if it receives
6362 a vote of two-thirds of all the members elected to each house, as
6463 provided by Section 39, Article III, Texas Constitution. If this
6564 Act does not receive the vote necessary for immediate effect, this
6665 Act takes effect September 1, 2019.
