44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the composition of the port commission of the Port of
77 Corpus Christi Authority of Nueces County, Texas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1A, Chapter 397, Acts of the 68th
1010 Legislature, Regular Session, 1983, as added by Chapter 498, Acts
1111 of the 81st Legislature, Regular Session, 2009, is amended to read
1212 as follows:
1313 Sec. 1A. COMPOSITION OF PORT COMMISSION. The port
1414 commission is composed of nine [seven] port commissioners members].
1515 SECTION 2. Section 2(a), Chapter 397, Acts of the 68th
1616 Legislature, Regular Session, 1983, is amended to read as follows:
1717 (a) Port commissioners are appointed as follows:
1818 (1) the commissioners court [The Commissioners Court]
1919 of Nueces County shall appoint three port commissioners;
2020 (2) the city council of the City of Corpus Christi
2121 shall appoint three port commissioners; and
2222 (3) the commissioners court of San Patricio County
2323 shall appoint three port commissioners, two of whom serve as
2424 non-voting commissioners in an advisory capacity only [four members
2525 to the port commission, and the City Council of Corpus Christi shall
2626 appoint three members to the port commission].
2727 SECTION 3. Sections 1, 2, 3, and 4, Chapter 1334, Acts of
2828 the 78th Legislature, Regular Session, 2003, are repealed.
2929 SECTION 4. Not later than one year after the effective date
3030 of this Act, the commissioners court of San Patricio County shall
3131 appoint two port commissioners to the port commission of the Port of
3232 Corpus Christi Authority of Nueces County, Texas, as provided by
3333 Section 2(a), Chapter 397, Acts of the 68th Legislature, Regular
3434 Session, 1983, as amended by this Act, to serve terms that expire on
3535 dates that preserve the required staggering of terms.
3636 SECTION 5. To the extent of any conflict, this Act prevails
3737 over another Act of the 86th Legislature, Regular Session, 2019,
3838 relating to nonsubstantive additions to and corrections in enacted
3939 codes.
4040 SECTION 6. (a) The legal notice of the intention to
4141 introduce this Act, setting forth the general substance of this
4242 Act, has been published as provided by law, and the notice and a
4343 copy of this Act have been furnished to all persons, agencies,
4444 officials, or entities to which they are required to be furnished
4545 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4646 Government Code.
4747 (b) The governor, one of the required recipients, has
4848 submitted the notice and Act to the Texas Commission on
4949 Environmental Quality.
5050 (c) The Texas Commission on Environmental Quality has filed
5151 its recommendations relating to this Act with the governor, the
5252 lieutenant governor, and the speaker of the house of
5353 representatives within the required time.
5454 (d) All requirements of the constitution and laws of this
5555 state and the rules and procedures of the legislature with respect
5656 to the notice, introduction, and passage of this Act are fulfilled
5757 and accomplished.
5858 SECTION 7. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2019.
