| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 21.401, Education Code, is amended by |
|---|
| 9 | 11 | | amending Subsection (b) and adding Subsection (c-1) to read as |
|---|
| 10 | 12 | | follows: |
|---|
| 11 | 13 | | (b) Except as provided by Subsection (c-1), an [An] educator |
|---|
| 12 | 14 | | employed under a 10-month contract must provide a minimum of 187 |
|---|
| 13 | 15 | | days of service. |
|---|
| 14 | 16 | | (c-1) If a school district anticipates providing less than |
|---|
| 15 | 17 | | 180 days of instruction for students during a school year, as |
|---|
| 16 | 18 | | indicated by the district's academic calendar, the district may |
|---|
| 17 | 19 | | reduce the number of days of service required by this section |
|---|
| 18 | 20 | | proportionately. A reduction by the district does not reduce an |
|---|
| 19 | 21 | | educator's salary. |
|---|
| 20 | 22 | | SECTION 2. Section 21.401, Education Code, as amended by |
|---|
| 21 | 23 | | this Act, applies only to a contract executed on or after the |
|---|
| 22 | 24 | | effective date of this Act. A contract executed before the |
|---|
| 23 | 25 | | effective date of this Act is governed by the law in effect on the |
|---|
| 24 | 26 | | date the contract was executed, and the former law is continued in |
|---|
| 25 | 27 | | effect for that purpose. |
|---|
| 26 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 32 | | Act takes effect September 1, 2019. |
