46 AN ACT
57 relating to a reduction in required days of service for educators in
68 public schools under certain circumstances.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 21.401, Education Code, is amended by
911 amending Subsection (b) and adding Subsection (c-1) to read as
1012 follows:
1113 (b) Except as provided by Subsection (c-1), an [An] educator
1214 employed under a 10-month contract must provide a minimum of 187
1315 days of service.
1416 (c-1) If a school district anticipates providing less than
1517 180 days of instruction for students during a school year, as
1618 indicated by the district's academic calendar, the district may
1719 reduce the number of days of service required by this section
1820 proportionately. A reduction by the district does not reduce an
1921 educator's salary.
2022 SECTION 2. Section 21.401, Education Code, as amended by
2123 this Act, applies only to a contract executed on or after the
2224 effective date of this Act. A contract executed before the
2325 effective date of this Act is governed by the law in effect on the
2426 date the contract was executed, and the former law is continued in
2527 effect for that purpose.
2628 SECTION 3. This Act takes effect immediately if it receives
2729 a vote of two-thirds of all the members elected to each house, as
2830 provided by Section 39, Article III, Texas Constitution. If this
2931 Act does not receive the vote necessary for immediate effect, this
3032 Act takes effect September 1, 2019.
