8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter I, Chapter 545, Transportation Code, | |
10 | 10 | is amended by adding Section 545.4141 to read as follows: | |
11 | 11 | Sec. 545.4141. CARRYING PERSON IN TRUNK; OFFENSE. (a) In | |
12 | 12 | this section, "trunk" means that portion of a motor vehicle that is: | |
13 | 13 | (1) designed for the transportation of cargo and not | |
14 | 14 | the transportation of the operator or passengers; and | |
15 | 15 | (2) enclosed on all sides and accessible only by means | |
16 | 16 | of a door or lid. | |
17 | 17 | (b) A person commits an offense if the person operates a | |
18 | 18 | motor vehicle on a highway or street while another person is | |
19 | 19 | occupying the trunk. | |
20 | 20 | (c) An offense under this section is a Class B misdemeanor. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2019. |
