| 10 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 10 | | SECTION 1. Subchapter B, Chapter 166, Health and Safety |
|---|
| 12 | 11 | | Code, is amended by adding Section 166.0465 to read as follows: |
|---|
| 13 | 12 | | Sec. 166.0465. ETHICS OR MEDICAL COMMITTEE POLICIES ON |
|---|
| 14 | 13 | | CONFLICTS OF INTEREST AND DISABILITY DISCRIMINATION. Each health |
|---|
| 15 | 14 | | care facility that provides review by an ethics or medical |
|---|
| 16 | 15 | | committee under Section 166.046 shall adopt and implement a policy |
|---|
| 17 | 16 | | on: |
|---|
| 18 | 17 | | (1) preventing substantial financial and health care |
|---|
| 19 | 18 | | professional conflicts of interest that may arise during the |
|---|
| 20 | 19 | | review; and |
|---|
| 21 | 20 | | (2) prohibiting consideration of a patient's permanent |
|---|
| 22 | 21 | | physical or mental disability during the review unless the |
|---|
| 23 | 22 | | disability is relevant in determining whether a medical or surgical |
|---|
| 24 | 23 | | intervention is medically appropriate. |
|---|
| 25 | 24 | | SECTION 2. (a) A health care facility shall adopt the |
|---|
| 26 | 25 | | policy required by Section 166.0465, Health and Safety Code, as |
|---|
| 27 | 26 | | added by this Act, not later than April 1, 2020. |
|---|
| 28 | 27 | | (b) A policy adopted under Section 166.0465, Health and |
|---|
| 29 | 28 | | Safety Code, as added by this Act, applies only to an ethics or |
|---|
| 30 | 29 | | medical committee review conducted on or after April 1, 2020. |
|---|
| 31 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
