55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the rendition of certain temporary orders in a suit
88 affecting the parent-child relationship in anticipation of a
99 parent's military deployment, military mobilization, or temporary
1010 military duty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 153.702, Family Code, is amended by
1313 adding Subsections (a-1) and (a-2) to read as follows:
1414 (a-1) A conservator may file for an order under this
1515 subchapter without having been ordered to military deployment,
1616 military mobilization, or temporary military duty if the
1717 conservator has reason to anticipate that:
1818 (1) the conservator will be ordered to military
1919 deployment, military mobilization, or temporary military duty
2020 during the one-year period following the date on which the
2121 conservator files for the order; and
2222 (2) there will be insufficient time for an expedited
2323 hearing under Section 153.707 on the issuance of a temporary order
2424 after the conservator is notified of upcoming military deployment,
2525 military mobilization, or temporary military duty.
2626 (a-2) A temporary order rendered based on a request filed
2727 under Subsection (a-1):
2828 (1) expires on the first anniversary of the date of
2929 issuance unless the conservator is ordered to military deployment,
3030 military mobilization, or temporary military duty before that date;
3131 and
3232 (2) takes effect on the date the conservator leaves
3333 for military deployment, military mobilization, or temporary
3434 military duty, provided that the military deployment, military
3535 mobilization, or temporary military duty is ordered before the
3636 temporary order expires.
3737 SECTION 2. This Act takes effect September 1, 2019.
