 A BILL TO BE ENTITLED
 AN ACT
 relating to the classification of certain hospitals.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 32, Human Resources Code, is amended by
 adding Section 32.0285 as follows:
 SECTION 32.0285.  CLASSIFICATION OF CERTAIN HOSPITALS FOR
 SUPPLEMENTAL REIMBURSEMENT PURPOSES.  (a) The executive
 commissioner in the adoption of reasonable rules and standards
 governing the determination and payment of supplemental
 reimbursement to hospitals shall ensure that a hospital which
 contracts with a hospital district is classified as a public
 hospital for supplemental reimbursement program reporting and
 reimbursement purposes if:
 (1)  the hospital district does not own or operate a
 public hospital; and
 (2)  the contract requires the hospital to discharge
 all or part of the district's indigent care or hospital care duties.
 (b)  For purposes of this section, "supplemental
 reimbursement program" includes, but is not limited to, the
 following programs:
 (1)  the disproportionate share hospital payment
 program;
 (2)  the uncompensated care, delivery system reform
 incentive payment, and other programs operated under the programs
 under Texas Health Care Transformation and Quality Improvement
 Program waiver issued under Section 1115 of the federal Social
 Security Act (42 U.S.C. Section 1315);
 (4)  the network access improvement program;
 (5)  any successor to a program identified in this
 subsection; and
 (6)  any supplemental hospital reimbursement programs
 that may be created or authorized in the future.
 SECTION 2.  This Act takes effect September 1, 2019.
