| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 32, Human Resources Code, is amended by |
|---|
| 9 | 9 | | adding Section 32.0285 as follows: |
|---|
| 10 | 10 | | SECTION 32.0285. CLASSIFICATION OF CERTAIN HOSPITALS FOR |
|---|
| 11 | 11 | | SUPPLEMENTAL REIMBURSEMENT PURPOSES. (a) The executive |
|---|
| 12 | 12 | | commissioner in the adoption of reasonable rules and standards |
|---|
| 13 | 13 | | governing the determination and payment of supplemental |
|---|
| 14 | 14 | | reimbursement to hospitals shall ensure that a hospital which |
|---|
| 15 | 15 | | contracts with a hospital district is classified as a public |
|---|
| 16 | 16 | | hospital for supplemental reimbursement program reporting and |
|---|
| 17 | 17 | | reimbursement purposes if: |
|---|
| 18 | 18 | | (1) the hospital district does not own or operate a |
|---|
| 19 | 19 | | public hospital; and |
|---|
| 20 | 20 | | (2) the contract requires the hospital to discharge |
|---|
| 21 | 21 | | all or part of the district's indigent care or hospital care duties. |
|---|
| 22 | 22 | | (b) For purposes of this section, "supplemental |
|---|
| 23 | 23 | | reimbursement program" includes, but is not limited to, the |
|---|
| 24 | 24 | | following programs: |
|---|
| 25 | 25 | | (1) the disproportionate share hospital payment |
|---|
| 26 | 26 | | program; |
|---|
| 27 | 27 | | (2) the uncompensated care, delivery system reform |
|---|
| 28 | 28 | | incentive payment, and other programs operated under the programs |
|---|
| 29 | 29 | | under Texas Health Care Transformation and Quality Improvement |
|---|
| 30 | 30 | | Program waiver issued under Section 1115 of the federal Social |
|---|
| 31 | 31 | | Security Act (42 U.S.C. Section 1315); |
|---|
| 32 | 32 | | (4) the network access improvement program; |
|---|
| 33 | 33 | | (5) any successor to a program identified in this |
|---|
| 34 | 34 | | subsection; and |
|---|
| 35 | 35 | | (6) any supplemental hospital reimbursement programs |
|---|
| 36 | 36 | | that may be created or authorized in the future. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2019. |
