66 relating to the classification of certain hospitals.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 32, Human Resources Code, is amended by
99 adding Section 32.0285 as follows:
1010 SECTION 32.0285. CLASSIFICATION OF CERTAIN HOSPITALS FOR
1111 SUPPLEMENTAL REIMBURSEMENT PURPOSES. (a) The executive
1212 commissioner in the adoption of reasonable rules and standards
1313 governing the determination and payment of supplemental
1414 reimbursement to hospitals shall ensure that a hospital which
1515 contracts with a hospital district is classified as a public
1616 hospital for supplemental reimbursement program reporting and
1717 reimbursement purposes if:
1818 (1) the hospital district does not own or operate a
1919 public hospital; and
2020 (2) the contract requires the hospital to discharge
2121 all or part of the district's indigent care or hospital care duties.
2222 (b) For purposes of this section, "supplemental
2323 reimbursement program" includes, but is not limited to, the
2424 following programs:
2525 (1) the disproportionate share hospital payment
2626 program;
2727 (2) the uncompensated care, delivery system reform
2828 incentive payment, and other programs operated under the programs
2929 under Texas Health Care Transformation and Quality Improvement
3030 Program waiver issued under Section 1115 of the federal Social
3131 Security Act (42 U.S.C. Section 1315);
3232 (4) the network access improvement program;
3333 (5) any successor to a program identified in this
3434 subsection; and
3535 (6) any supplemental hospital reimbursement programs
3636 that may be created or authorized in the future.
3737 SECTION 2. This Act takes effect September 1, 2019.
