| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 542.052, Insurance Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 542.052. APPLICABILITY OF SUBCHAPTER. (a) This |
|---|
| 14 | 14 | | subchapter applies to any insurer authorized to engage in business |
|---|
| 15 | 15 | | as an insurance company or to provide insurance in this state, |
|---|
| 16 | 16 | | including: |
|---|
| 17 | 17 | | (1) a stock life, health, or accident insurance |
|---|
| 18 | 18 | | company; |
|---|
| 19 | 19 | | (2) a mutual life, health, or accident insurance |
|---|
| 20 | 20 | | company; |
|---|
| 21 | 21 | | (3) a stock fire or casualty insurance company; |
|---|
| 22 | 22 | | (4) a mutual fire or casualty insurance company; |
|---|
| 23 | 23 | | (5) a Mexican casualty insurance company; |
|---|
| 24 | 24 | | (6) a Lloyd's plan; |
|---|
| 25 | 25 | | (7) a reciprocal or interinsurance exchange; |
|---|
| 26 | 26 | | (8) a fraternal benefit society; |
|---|
| 27 | 27 | | (9) a stipulated premium company; |
|---|
| 28 | 28 | | (10) a nonprofit legal services corporation; |
|---|
| 29 | 29 | | (11) a statewide mutual assessment company; |
|---|
| 30 | 30 | | (12) a local mutual aid association; |
|---|
| 31 | 31 | | (13) a local mutual burial association; |
|---|
| 32 | 32 | | (14) an association exempt under Section 887.102; |
|---|
| 33 | 33 | | (15) a nonprofit hospital, medical, or dental service |
|---|
| 34 | 34 | | corporation, including a corporation subject to Chapter 842; |
|---|
| 35 | 35 | | (16) a county mutual insurance company; |
|---|
| 36 | 36 | | (17) a farm mutual insurance company; |
|---|
| 37 | 37 | | (18) a risk retention group; |
|---|
| 38 | 38 | | (19) a purchasing group; |
|---|
| 39 | 39 | | (20) an eligible surplus lines insurer; and |
|---|
| 40 | 40 | | (21) except as provided by Section 542.053(b), a |
|---|
| 41 | 41 | | guaranty association operating under Chapter 462 or 463. |
|---|
| 42 | 42 | | (b) Notwithstanding any other law, this subchapter applies |
|---|
| 43 | 43 | | to a claim under health and accident coverage provided by a risk |
|---|
| 44 | 44 | | pool created under Chapter 172, Local Government Code, and the risk |
|---|
| 45 | 45 | | pool shall be treated as an insurer for purposes of this subchapter. |
|---|
| 46 | 46 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 47 | 47 | | to a claim filed on or after the effective date of this Act. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2019. |
