46 AN ACT
57 relating to the Texas Diabetes Council and the state plan for
68 diabetes and obesity treatment and education.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 103.001(2), Health and Safety Code, is
911 amended to read as follows:
1012 (2) "Person with diabetes" means a person diagnosed by
1113 a physician in accordance with nationally recognized standards as
1214 having diabetes.
1315 SECTION 2. Sections 103.002(a), (b), and (c), Health and
1416 Safety Code, are amended to read as follows:
1517 (a) The Texas Diabetes Council is composed of 11 citizen
1618 members appointed from the public and one representative each from
1719 the department, the commission, the Employees Retirement System of
1820 Texas, the Teacher Retirement System of Texas, and the Texas
1921 Workforce Commission vocational rehabilitation services division
2022 [Department of Assistive and Rehabilitative Services].
2123 (b) The governor, with the advice and consent of the senate,
2224 shall appoint the following citizen members:
2325 (1) a licensed physician with a specialization in
2426 treating diabetes;
2527 (2) a registered nurse with a specialization in
2628 diabetes education and training;
2729 (3) a registered and licensed dietitian with a
2830 specialization in the diabetes education field;
2931 (4) a person with experience and training in public
3032 health policy;
3133 (5) three consumer members, with special
3234 consideration given to persons active in the Texas affiliates of
3335 the Juvenile Diabetes Research Foundation (JDRF), the American
3436 Association of Diabetes Educators, or the American Diabetes
3537 Association; and
3638 (6) four members from the general public with
3739 expertise or demonstrated commitment to diabetes issues.
3840 (c) The commissioner, executive commissioner, executive
3941 director of the Employees Retirement System of Texas, executive
4042 director of the Teacher Retirement System of Texas, and the
4143 director of the Texas Workforce Commission vocational
4244 rehabilitation services division [commissioner of assistive and
4345 rehabilitative services] shall appoint that agency's
4446 representative to the council. Agency representatives shall be
4547 nonvoting members of the council.
4648 SECTION 3. Section 103.010, Health and Safety Code, is
4749 amended to read as follows:
4850 Sec. 103.010. STAFF AND ADMINISTRATIVE SUPPORT. (a) Each
4951 agency represented on the council shall provide the council with
5052 periodic staff support of specialists as needed and may provide
5153 staff support to an advisory committee.
5254 (b) The department shall provide administrative support to
5355 the council by providing research services and preparing any
5456 reports required under this chapter.
5557 SECTION 4. Section 103.011, Health and Safety Code, is
5658 amended to read as follows:
5759 Sec. 103.011. ADVISORY COMMITTEES; WORK GROUPS. (a) The
5860 council may establish advisory committees or work groups that the
5961 council considers necessary and may determine the appropriate
6062 membership for each committee or group.
6163 (b) The council shall specify the purpose and duties of each
6264 advisory committee or work group and shall specify any product the
6365 committee is required to develop.
6466 (c) Members of an advisory committee or work group serve at
6567 the will of the council. The council may dissolve an advisory
6668 committee or work group when necessary.
6769 SECTION 5. Section 103.013, Health and Safety Code, is
6870 amended by adding Subsection (b-1) to read as follows:
6971 (b-1) The state plan may include provisions to address
7072 obesity treatment, education, and training related to:
7173 (1) obesity-dependent diabetes; and
7274 (2) the health impacts of obesity on a person with
7375 diabetes.
7476 SECTION 6. Sections 103.014(a) and (c), Health and Safety
7577 Code, are amended to read as follows:
7678 (a) The council shall address contemporary issues affecting
7779 health promotion services in the state, including:
7880 (1) professional and patient education;
7981 (2) evidence-based [successful] diabetes
8082 self-management education strategies;
8183 (3) evidence-based strategies to achieve the council's
8284 mission [personnel preparation and continuing education];
8385 (4) state expenditures for the prevention, detection,
8486 management, and treatment of diabetes and obesity [chronic
8587 diseases]; and
8688 (5) [screening services; and
8789 [(6)] public awareness of the specific risks and
8890 benefits of prevention, detection, management, and treatment of
8991 diabetes, including obesity-dependent diabetes.
9092 (c) The council may establish priorities and make
9193 recommendations for program expenditures that align with the
9294 council's mission[:
9395 [(1) compile and publish regional directories of
9496 services for persons with diabetes;
9597 [(2) design or adapt and publish a handbook in English
9698 and Spanish relating to diet, exercise, and other self-care
9799 management skills for persons with diabetes;
98100 [(3) study the feasibility of a statewide hotline for
99101 persons with diabetes; and
100102 [(4) study the standards and structure of pilot
101103 programs to provide diabetes education and training in this state].
102104 SECTION 7. Sections 103.017(a) and (c), Health and Safety
103105 Code, are amended to read as follows:
104106 (a) The department, commission, and Texas Workforce
105107 Commission vocational rehabilitation services division [Department
106108 of Assistive and Rehabilitative Services] shall work with the
107109 council to jointly develop, produce, and implement a general public
108110 awareness strategy focusing on diabetes, its complications, and
109111 techniques for achieving good management. Each agency shall pay
110112 for the costs of producing and disseminating information on
111113 diabetes to clients served by that agency.
112114 (c) The department, commission, and Texas Workforce
113115 Commission vocational rehabilitation services division [Department
114116 of Assistive and Rehabilitative Services] may jointly develop and
115117 implement a statewide plan for conducting regional training
116118 sessions for public and private service providers, including
117119 institutional health care providers, who have routine contact with
118120 persons with diabetes.
119121 SECTION 8. Section 103.0175, Health and Safety Code, is
120122 amended to read as follows:
121123 Sec. 103.0175. MATERIALS FOR SCHOOL-BASED AND
122124 SCHOOL-LINKED CLINICS. The council, in consultation with the
123125 department and the Texas Education Agency, shall develop and make
124126 available materials that provide information about diabetes to be
125127 distributed to students and the parents of students by health
126128 clinics at public primary or secondary schools.
127129 SECTION 9. This Act takes effect September 1, 2019.
