66 AN ACT
77 relating to allowing operators of motor vehicles to treat a stop
88 sign as a yield sign at certain intersections.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 545, Transportation Code,
1111 is amended by adding Section 545.1531 to read as follows:
1212 Sec. 545.1531. STOP SIGN CONSIDERED YIELD SIGN IN CERTAIN
1313 CIRCUMSTANCES. (a) The provisions of Sections 544.010 and
1414 545.151(a) applicable to stop signs do not apply to the operator of
1515 a vehicle approaching an intersection with a stop sign and no other
1616 traffic-control signal or police officer directing traffic, if:
1717 (1) no pedestrian is in the intersection; and
1818 (2) no vehicle on the other street or roadway is in the
1919 intersection or approaching the intersection in such proximity as
2020 to be a hazard.
2121 (b) A person operating a vehicle and approaching an
2222 intersection as described by Subsection (a) shall:
2323 (1) when approaching the intersection, slow to a speed
2424 that is reasonable under existing conditions, not to exceed 10
2525 miles per hour; and
2626 (2) comply with the provisions of Section 545.153
2727 applicable to yield signs when approaching the intersection.
2828 SECTION 2. The changes in law made by this Act apply only to
2929 an offense committed on or after the effective date of this Act. An
3030 offense committed before the effective date of this Act is governed
3131 by the law in effect on the date the offense was committed, and the
3232 former law is continued in effect for that purpose. For purposes of
3333 this section, an offense was committed before the effective date of
3434 this Act if any element of the offense was committed before that
3535 date.
3636 SECTION 3. This Act takes effect September 1, 2019.
