66 AN ACT
77 relating to creating the criminal offenses of providing material
88 support or resources to a foreign terrorist organization and
99 engaging in terrorist activities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Title 11, Penal Code, is amended
1212 to read as follows:
1313 TITLE 11. ORGANIZED CRIME AND TERRORISM
1414 SECTION 2. Title 11, Penal Code, is amended by adding
1515 Chapter 72 to read as follows:
1616 CHAPTER 72. TERRORISM
1717 Sec. 72.01. DEFINITIONS. In this chapter:
1818 (1) "Foreign terrorist organization" means an
1919 organization designated as a foreign terrorist organization under 8
2020 U.S.C. Section 1189.
2121 (2) "Material support or resources" means any
2222 property, service, or personnel.
2323 (3) "Property" means:
2424 (A) real property;
2525 (B) tangible or intangible personal property,
2626 including anything severed from land; or
2727 (C) a document, including money, that represents
2828 or embodies anything of value.
2929 (4) "Service" includes:
3030 (A) labor and professional service;
3131 (B) telecommunication, public utility, or
3232 transportation service;
3333 (C) lodging, restaurant service, and
3434 entertainment; and
3535 (D) the supply of a motor vehicle or other
3636 property for use.
3737 Sec. 72.02. PROVIDING MATERIAL SUPPORT OR RESOURCES TO
3838 FOREIGN TERRORIST ORGANIZATION. (a) A person commits an offense if
3939 the person knowingly provides material support or resources to a
4040 foreign terrorist organization.
4141 (b) An offense under this section is a felony of the first
4242 degree.
4343 Sec. 72.03. ENGAGING IN TERRORIST ACTIVITIES. (a) A person
4444 commits an offense if the person, with intent to support or
4545 participate in the activities of a foreign terrorist organization,
4646 commits or conspires to commit one or more of the following:
4747 (1) kidnapping;
4848 (2) robbery;
4949 (3) arson;
5050 (4) trafficking of persons;
5151 (5) any felony offense under Chapter 31 or 32;
5252 (6) money laundering;
5353 (7) any unlawful manufacture, delivery, dispensation,
5454 or distribution of a controlled substance or dangerous drug that is
5555 punishable as a felony;
5656 (8) tampering with a witness;
5757 (9) tampering with or fabricating physical evidence;
5858 (10) tampering with a governmental record; or
5959 (11) hindering apprehension or prosecution.
6060 (b) Except as provided by Subsections (c) and (d), an
6161 offense under this section is one category higher than the most
6262 serious offense listed in Subsection (a) that was committed.
6363 (c) If the most serious offense listed in Subsection (a)
6464 that was committed is a felony of the first degree, an offense under
6565 this section is a felony of the first degree punishable by
6666 imprisonment in the Texas Department of Criminal Justice for life
6767 or for any term of not more than 99 years or less than 15 years.
6868 (d) If the most serious offense listed in Subsection (a)
6969 that was committed is described by Subsection (a)(10) or (11), an
7070 offense under this section is a felony of the third degree.
7171 Sec. 72.04. APPLICABILITY OF OTHER LAW. If conduct that
7272 constitutes an offense under this chapter also constitutes an
7373 offense under other law, the actor may be prosecuted under this
7474 section, the other law, or both.
7575 SECTION 3. This Act takes effect September 1, 2019.
