| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 222.053, Transportation Code, is amended |
|---|
| 9 | 11 | | by adding Subsections (a-1) and (a-2) to read as follows: |
|---|
| 10 | 12 | | (a-1) Notwithstanding Subsection (a), a county is |
|---|
| 11 | 13 | | considered to be an "economically disadvantaged county" for the |
|---|
| 12 | 14 | | purposes of this section if it meets the criteria as laid out in |
|---|
| 13 | 15 | | Subsection (a) within the past six years and has been included in no |
|---|
| 14 | 16 | | less than five federally declared disasters within the same time |
|---|
| 15 | 17 | | period. |
|---|
| 16 | 18 | | (a-2) For a county described by Subsection (a-1), the |
|---|
| 17 | 19 | | adjustment to the local matching funds requirement shall be |
|---|
| 18 | 20 | | equivalent to the highest adjustment rate set in the last year the |
|---|
| 19 | 21 | | county was considered to meet the criteria described in Subsection |
|---|
| 20 | 22 | | (a). |

| 21 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 27 | | Act takes effect September 1, 2019. |
