| 7 | 7 | | relating to certain fees of and costs incurred by sheriffs and |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 118.131(h), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (h) If the commissioners court does not set fees under this |
|---|
| 13 | 13 | | section, the fees for services by the offices of the sheriff and |
|---|
| 14 | 14 | | constables are those fees provided by law in effect for the |
|---|
| 15 | 15 | | preceding fiscal year [on August 31, 1981]. |

| 16 | 16 | | SECTION 2. Section 118.133(d), Local Government Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (d) Fees collected under this section [Act] shall be |
|---|
| 19 | 19 | | deposited in the county treasury to the credit of the general fund |
|---|
| 20 | 20 | | of the county. |
|---|
| 21 | 21 | | SECTION 3. Section 118.134(b), Local Government Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | (b) Subsection (a) of this section does not apply to costs |
|---|
| 24 | 24 | | incurred on property seized in conjunction with an offense alleged |
|---|
| 25 | 25 | | under the Penal Code, the Code of Criminal Procedure, or Title 6 or |
|---|
| 26 | 26 | | 7, Transportation Code [Title 116, Vernon's Texas Civil Statutes], |
|---|
| 27 | 27 | | when the owner of the property is subsequently found to be not |
|---|
| 28 | 28 | | guilty of an offense or other proscribed activity described in |
|---|
| 29 | 29 | | those statutes, or if other charges whether criminal or civil are |
|---|
| 30 | 30 | | dropped. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect September 1, 2019. |
