49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the confinement of juveniles in certain facilities.
712 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
813 SECTION 1. Section 203.018, Human Resources Code, is
914 amended to read as follows:
1015 Sec. 203.018. SPECIALIZED PROGRAMS AND SPECIAL PROJECTS.
1116 (a) The department shall develop specialized programs for
1217 children with a determinate sentence and children committed under
1318 Section 54.04013, Family Code. The programs must ensure safety and
1419 security for committed children and provide developmentally
1520 appropriate program strategies.
1621 (b) The department shall establish performance-based goals
1722 related to improved outcomes that:
1823 (1) must include measures to reduce recidivism; and
1924 (2) shall include other well-being outcome measures.
2025 (c) The department shall use case review strategies to
2126 identify children in department facilities who can safely and
2227 appropriately be transferred to alternative local placements or
2328 halfway houses, placed on parole, or discharged from the
2429 department.
2530 (d) The department shall study and report to the board on
2631 the potential for repurposing existing secure facilities for the
2732 confinement of children with a determinate sentence or children
2833 committed under Section 54.04013, Family Code, or for other
2934 purposes.
3035 [(e) The department or any local probation department may
3136 not use or contract with a facility that was constructed or
3237 previously used for the confinement of adult offenders.]
3338 SECTION 2. This Act takes effect September 1, 2019.
