7 | 7 | | relating to the confidentiality of the recording of certain |
---|
8 | 8 | | emergency calls. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |
---|
11 | 11 | | amended by adding Section 552.157 to read as follows: |
---|
12 | 12 | | Sec. 552.157. EXCEPTION: CONFIDENTIALITY OF RECORDING OF |
---|
13 | 13 | | CERTAIN EMERGENCY CALLS. (a) A recording of an emergency call made |
---|
14 | 14 | | to a public safety agency or a public safety answering point, as |
---|
15 | 15 | | those terms are defined by Section 772.001, Health and Safety Code, |
---|
16 | 16 | | that contains the final words spoken by an individual is |
---|
17 | 17 | | confidential. |
---|
18 | 18 | | (b) A governmental body shall disclose information that is |
---|
19 | 19 | | confidential under this section and that is not confidential or |
---|
20 | 20 | | otherwise excepted from required disclosure under another |
---|
21 | 21 | | provision of law to a requestor who: |
---|
22 | 22 | | (1) is an investigator licensed under Chapter 1702, |
---|
23 | 23 | | Occupations Code, who certifies that the information will only be |
---|
24 | 24 | | used in conjunction with a civil, criminal, administrative, or |
---|
25 | 25 | | arbitral proceeding in a court or government agency, including |
---|
26 | 26 | | service of process, investigation in anticipation of litigation, |
---|
27 | 27 | | execution or enforcement of a judgment or order, or under any order |
---|
28 | 28 | | of any court; or |
---|
29 | 29 | | (2) is a first responder as defined by Section |
---|
30 | 30 | | 421.095. |
---|
31 | 31 | | (c) A governmental body may withhold a recording described |
---|
32 | 32 | | by Subsection (a) without the necessity of requesting a decision |
---|
33 | 33 | | from the attorney general under Subchapter G. |
---|
34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2019. |
