55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the confidentiality of the recording of certain
88 emergency calls.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1111 amended by adding Section 552.157 to read as follows:
1212 Sec. 552.157. EXCEPTION: CONFIDENTIALITY OF RECORDING OF
1313 CERTAIN EMERGENCY CALLS. (a) A recording of an emergency call made
1414 to a public safety agency or a public safety answering point, as
1515 those terms are defined by Section 772.001, Health and Safety Code,
1616 that contains the final words spoken by an individual is
1717 confidential.
1818 (b) A governmental body shall disclose information that is
1919 confidential under this section and that is not confidential or
2020 otherwise excepted from required disclosure under another
2121 provision of law to a requestor who:
2222 (1) is an investigator licensed under Chapter 1702,
2323 Occupations Code, who certifies that the information will only be
2424 used in conjunction with a civil, criminal, administrative, or
2525 arbitral proceeding in a court or government agency, including
2626 service of process, investigation in anticipation of litigation,
2727 execution or enforcement of a judgment or order, or under any order
2828 of any court; or
2929 (2) is a first responder as defined by Section
3030 421.095.
3131 (c) A governmental body may withhold a recording described
3232 by Subsection (a) without the necessity of requesting a decision
3333 from the attorney general under Subchapter G.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2019.
