66 AN ACT
77 relating to private spaces for diaper changing stations in
88 restrooms in certain buildings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 341, Health and Safety
1111 Code, is amended by adding Section 341.070 to read as follows:
1212 Sec. 341.070. DIAPER CHANGING STATIONS. (a) In this
1313 section:
1414 (1) "Health facility" means a facility licensed under
1515 Subtitle B, Title 4.
1616 (2) "Historic structure" has the meaning assigned by
1717 Section 442.001, Government Code.
1818 (b) This section does not apply to:
1919 (1) a restroom renovation with an estimated cost of
2020 less than $10,000;
2121 (2) the construction or renovation of a building for
2222 which the governmental entity issuing the building permit
2323 determines that installing a diaper changing station would:
2424 (A) be infeasible;
2525 (B) result in noncompliance with federal, state,
2626 or local health, life safety, or building code requirements; or
2727 (C) limit the accessibility of a restroom to a
2828 person with a disability;
2929 (3) an industrial building, nightclub, bar,
3030 retirement community, or other establishment that restricts access
3131 to the premises based on age;
3232 (4) a health facility with single-occupancy
3333 restrooms;
3434 (5) a historic structure;
3535 (6) a restaurant with a seating capacity of less than
3636 50 persons; or
3737 (7) a building in which a centrally located facility
3838 with a diaper changing station is available for public use.
3939 (c) A person who engages in or contracts for the
4040 construction of a building, or the renovation of the restrooms of a
4141 building, with one or more restrooms accessible to the public,
4242 including a building owned or leased by this state or a political
4343 subdivision of this state, shall ensure that every member of the
4444 public has access to a private space for a diaper changing station
4545 in at least one restroom.
4646 (d) Each diaper changing station shall be maintained,
4747 repaired, and replaced as necessary and cleaned with the same
4848 frequency as the restroom in which the station is located.
4949 SECTION 2. The changes in law made by this Act apply only to
5050 the construction or renovation of a building with restrooms
5151 accessible to the public that begins on or after January 1, 2020.
5252 SECTION 3. This Act takes effect September 1, 2019.
