57 relating to the 1st Multicounty Court at Law.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Section 25.2702, Government Code, is amended by
810 amending Subsection (d) and adding Subsections (d-1) and (d-2) to
911 read as follows:
1012 (d) The judge of the county court at law shall appoint an
1113 official court reporter. The judge may appoint a court
1214 administrator to aid the judge in the performance of the judge's
1315 duties. The official court reporter and the court administrator of
1416 the county court at law are entitled to receive a salary set by the
1517 commissioners courts in the counties the reporter or administrator
1618 serves to be paid out of the county treasuries, either by salary or
1719 by contract as set by the commissioners courts [the same salary and
1820 to be paid in the same manner as the official court reporter and
1921 court administrator, respectively, of the district court in the
2022 administrative county for the court]. The clerk of the court shall
2123 tax as costs, in each civil, criminal, and probate case in which a
2224 record of any part of the evidence in the case is made by the
2325 reporter, a stenographer's fee of $25. The fee shall be paid in the
2426 same manner as other costs in the case. The clerk collects the fee
2527 and pays it into the general funds of the counties.
2628 (d-1) Fisher, Mitchell, and Nolan Counties shall enter into
2729 an interlocal agreement allocating the financial obligations of
2830 each county in relation to the county court at law and the budget,
2931 powers, and duties of the court and salaries of court personnel.
3032 (d-2) If the counties served by the county court at law are
3133 unable to reach an agreement under Subsection (d-1) before the
3234 first day of the fiscal year for a county served by the court, each
3335 county shall pay to the court's administrative county a share of the
3436 court's administrative and operational costs for the fiscal year
3537 based on the proportion of the court's caseload originating in the
3638 county during the preceding year. A county is entitled to
3739 compensation from the state under Section 25.0015 in proportion to
3840 the amount paid under this subsection.
3941 SECTION 2. This Act takes effect immediately if it receives
4042 a vote of two-thirds of all the members elected to each house, as
4143 provided by Section 39, Article III, Texas Constitution. If this
4244 Act does not receive the vote necessary for immediate effect, this
4345 Act takes effect September 1, 2019.
