6 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 9 | | SECTION 1. Section 25.2702, Government Code, is amended by |
---|
8 | 10 | | amending Subsection (d) and adding Subsections (d-1) and (d-2) to |
---|
9 | 11 | | read as follows: |
---|
10 | 12 | | (d) The judge of the county court at law shall appoint an |
---|
11 | 13 | | official court reporter. The judge may appoint a court |
---|
12 | 14 | | administrator to aid the judge in the performance of the judge's |
---|
13 | 15 | | duties. The official court reporter and the court administrator of |
---|
14 | 16 | | the county court at law are entitled to receive a salary set by the |
---|
15 | 17 | | commissioners courts in the counties the reporter or administrator |
---|
16 | 18 | | serves to be paid out of the county treasuries, either by salary or |
---|
17 | 19 | | by contract as set by the commissioners courts [the same salary and |
---|
18 | 20 | | to be paid in the same manner as the official court reporter and |
---|
19 | 21 | | court administrator, respectively, of the district court in the |
---|
20 | 22 | | administrative county for the court]. The clerk of the court shall |
---|
21 | 23 | | tax as costs, in each civil, criminal, and probate case in which a |
---|
22 | 24 | | record of any part of the evidence in the case is made by the |
---|
23 | 25 | | reporter, a stenographer's fee of $25. The fee shall be paid in the |
---|
24 | 26 | | same manner as other costs in the case. The clerk collects the fee |
---|
25 | 27 | | and pays it into the general funds of the counties. |
---|
26 | 28 | | (d-1) Fisher, Mitchell, and Nolan Counties shall enter into |
---|
27 | 29 | | an interlocal agreement allocating the financial obligations of |
---|
28 | 30 | | each county in relation to the county court at law and the budget, |
---|
29 | 31 | | powers, and duties of the court and salaries of court personnel. |
---|
30 | 32 | | (d-2) If the counties served by the county court at law are |
---|
31 | 33 | | unable to reach an agreement under Subsection (d-1) before the |
---|
32 | 34 | | first day of the fiscal year for a county served by the court, each |
---|
33 | 35 | | county shall pay to the court's administrative county a share of the |
---|
34 | 36 | | court's administrative and operational costs for the fiscal year |
---|
35 | 37 | | based on the proportion of the court's caseload originating in the |
---|
36 | 38 | | county during the preceding year. A county is entitled to |
---|
37 | 39 | | compensation from the state under Section 25.0015 in proportion to |
---|
38 | 40 | | the amount paid under this subsection. |
---|
39 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
---|
40 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 45 | | Act takes effect September 1, 2019. |
