A BILL TO BE ENTITLED
AN ACT
relating to creating a criminal offense for making certain
telemarketing calls to a telephone number published on the Texas
no-call list.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter F, Chapter 304, Business & Commerce
Code, is amended by adding Section 304.260 to read as follows:
Sec. 304.260. CRIMINAL PENALTY. (a) A person who violates
Section 304.052 commits an offense.
(b) An offense under this section is a Class B misdemeanor,
except that the offense is a Class A misdemeanor if it is shown on
the trial of the offense that the person has been previously
convicted of an offense under this section.
SECTION 2. This Act takes effect September 1, 2019.
