77 relating to the establishment of the Pediatric Acute-Onset
88 Neuropsychiatric Syndrome Advisory Council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle E, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 119A to read as follows:
1212 CHAPTER 119A. PEDIATRIC ACUTE-ONSET NEUROPSYCHIATRIC SYNDROME
1313 ADVISORY COUNCIL
1414 Sec. 119A.001. DEFINITION. In this chapter, "advisory
1515 council" means the Pediatric Acute-Onset Neuropsychiatric Syndrome
1616 Advisory Council established under this chapter.
1717 Sec. 119A.002. ESTABLISHMENT OF ADVISORY COUNCIL. The
1818 Pediatric Acute-Onset Neuropsychiatric Syndrome Advisory Council
1919 is established to advise the commission and the legislature on
2020 research, diagnosis, treatment, and education related to pediatric
2121 acute-onset neuropsychiatric syndrome.
2222 Sec. 119A.003. APPOINTMENT OF ADVISORY COUNCIL MEMBERS.
2323 (a) The advisory council is composed of the following 19 members:
2424 (1) one member designated by the executive
2525 commissioner;
2626 (2) two members of the senate appointed by the
2727 lieutenant governor;
2828 (3) two members of the house of representatives
2929 appointed by the speaker of the house of representatives; and
3030 (4) 14 members appointed by the governor with the
3131 following qualifications:
3232 (A) one member who is a licensed health care
3333 provider with expertise in treating persons with pediatric
3434 acute-onset neuropsychiatric syndrome, including pediatric
3535 autoimmune neuropsychiatric disorders associated with
3636 streptococcal infections, and autism;
3737 (B) one member who is an osteopathic physician
3838 with experience treating persons with pediatric acute-onset
3939 neuropsychiatric syndrome, including pediatric autoimmune
4040 neuropsychiatric disorders associated with streptococcal
4141 infections;
4242 (C) one member who is a pediatrician with
4343 experience treating persons with pediatric acute-onset
4444 neuropsychiatric syndrome, including pediatric autoimmune
4545 neuropsychiatric disorders associated with streptococcal
4646 infections;
4747 (D) one member who is a child psychiatrist with
4848 experience treating persons with pediatric acute-onset
4949 neuropsychiatric syndrome, including pediatric autoimmune
5050 neuropsychiatric disorders associated with streptococcal
5151 infections;
5252 (E) one member who is an immunologist with
5353 experience treating persons with pediatric acute-onset
5454 neuropsychiatric syndrome, including pediatric autoimmune
5555 neuropsychiatric disorders associated with streptococcal
5656 infections, and the use of intravenous immunoglobulin;
5757 (F) one member who is a dietician or nutritionist
5858 who provides services to children with autism spectrum disorders,
5959 attention-deficit/hyperactivity disorders, and other
6060 neuro-developmental conditions;
6161 (G) one member with experience in conducting
6262 research on pediatric acute-onset neuropsychiatric syndrome,
6363 including pediatric autoimmune neuropsychiatric disorders
6464 associated with streptococcal infections, obsessive-compulsive
6565 disorder, tic disorders, and other neurological disorders;
6666 (H) one member who is licensed by this state to
6767 practice as a social worker;
6868 (I) one member who is a representative of the
6969 Texas Education Agency with expertise in special education
7070 services;
7171 (J) one member who is a representative of a
7272 professional organization in this state for school psychologists;
7373 (K) one member who is a representative of a
7474 professional organization in this state for school nurses;
7575 (L) one member who is a representative of an
7676 advocacy and support group in this state for individuals affected
7777 by pediatric acute-onset neuropsychiatric syndrome, including
7878 pediatric autoimmune neuropsychiatric disorders associated with
7979 streptococcal infections;
8080 (M) one member who is a representative of an
8181 advocacy and support group in this state for individuals affected
8282 by autism; and
8383 (N) one member who is a parent of a child who has
8484 been diagnosed with pediatric acute-onset neuropsychiatric
8585 syndrome or autism.
8686 (b) The member designated by the executive commissioner
8787 serves as an ex officio nonvoting member. In the event of a tie vote
8888 among the members of the advisory council, the member designated by
8989 the executive commissioner may cast the deciding vote.
9090 (c) Each member of the advisory council must be a citizen of
9191 this state.
9292 Sec. 119A.004. TERMS; VACANCY. (a) Advisory council
9393 members appointed by the lieutenant governor and the speaker of the
9494 house of representatives serve terms that coincide with their
9595 offices. The remaining members serve two-year terms.
9696 (b) A vacancy on the advisory council shall be filled in the
9797 same manner as the original appointment.
9898 (c) A member appointed to fill a vacancy holds the office
9999 for the unexpired portion of the term.
100100 (d) Each member may be reappointed to serve on the advisory
101101 council.
102102 Sec. 119A.005. CHAIR AND VICE-CHAIR. Members of the
103103 advisory council shall elect from among the legislative members of
104104 the advisory council a chair and vice-chair.
105105 Sec. 119A.006. MEETINGS; QUORUM. (a) The advisory council
106106 shall meet at times and locations as determined by the chair or a
107107 majority of the members of the advisory council.
108108 (b) A majority of the members of the advisory council
109109 constitute a quorum.
110110 Sec. 119A.007. ANNUAL REPORT. Not later than September 1 of
111111 each year, the advisory council shall prepare and submit to the
112112 governor, legislature, and commission a written report that
113113 includes recommendations on:
114114 (1) practice guidelines for the diagnosis and
115115 treatment of pediatric acute-onset neuropsychiatric syndrome,
116116 including pediatric autoimmune neuropsychiatric disorders
117117 associated with streptococcal infections;
118118 (2) mechanisms to increase clinical awareness and
119119 education regarding pediatric acute-onset neuropsychiatric
120120 syndrome, including pediatric autoimmune neuropsychiatric
121121 disorders associated with streptococcal infections, among
122122 physicians, including pediatricians, school-based health centers,
123123 and mental health care providers;
124124 (3) strategies for outreach to educators and parents
125125 to increase awareness of pediatric acute-onset neuropsychiatric
126126 syndrome, including pediatric autoimmune neuropsychiatric
127127 disorders associated with streptococcal infections; and
128128 (4) developing a network of volunteer experts on the
129129 diagnosis and treatment of pediatric acute-onset neuropsychiatric
130130 syndrome, including pediatric autoimmune neuropsychiatric
131131 disorders associated with streptococcal infections, to assist in
132132 the delivery of education and outreach.
133133 Sec. 119A.008. COMPENSATION AND REIMBURSEMENT. A member of
134134 the advisory council is not entitled to compensation or
135135 reimbursement for expenses incurred in performing advisory council
136136 duties.
137137 Sec. 119A.009. SUNSET PROVISION. The Pediatric Acute-Onset
138138 Neuropsychiatric Syndrome Advisory Council is subject to Chapter
139139 325, Government Code (Texas Sunset Act). Unless continued in
140140 existence as provided by that chapter, the advisory council is
141141 abolished and this chapter expires September 1, 2031.
142142 Sec. 119A.010. APPLICABILITY OF OTHER LAW. Chapter 2110,
143143 Government Code, does not apply to the advisory council.
144144 SECTION 2. Not later than December 31, 2019, the governor,
145145 lieutenant governor, speaker of the house of representatives, and
146146 executive commissioner of the Health and Human Services Commission
147147 shall appoint the members to the Pediatric Acute-Onset
148148 Neuropsychiatric Syndrome Advisory Council as required by Section
149149 119A.003, Health and Safety Code, as added by this Act.
150150 SECTION 3. This Act takes effect September 1, 2019.
