66 AN ACT
77 relating to changing the sales and use tax rate of a metropolitan
88 rapid transit authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 451.407, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 451.407. RATE DECREASE: SALES AND USE TAX. (a) The
1313 board may:
1414 (1) decrease by order the authority's sales and use tax
1515 rate; or
1616 (2) order an election to decrease the rate.
1717 (b) The registered voters of an authority, by petition, may
1818 require an election to decrease the authority's sales and use tax
1919 rate, as provided by Section 451.409.
2020 SECTION 2. The heading to Section 451.409, Transportation
2121 Code, is amended to read as follows:
2222 Sec. 451.409. SALES AND USE TAX RATE INCREASE OR DECREASE:
2323 PETITION AND ELECTION.
2424 SECTION 3. Sections 451.409(a), (b), and (d),
2525 Transportation Code, are amended to read as follows:
2626 (a) A petition to increase or decrease the rate of an
2727 authority's sales and use tax is valid only if it is submitted to
2828 the board and signed by at least 10 percent of the authority's
2929 registered voters as determined by the most recent official list of
3030 registered voters.
3131 (b) The board shall submit a petition for an election to
3232 increase or decrease the authority's sales and use tax rate to the
3333 secretary of state.
3434 (d) The board shall call an election to increase or decrease
3535 the tax rate if the secretary determines that a petition is valid or
3636 if the secretary fails to act within the period required by
3737 Subsection (c).
3838 SECTION 4. This Act takes effect September 1, 2019.
