| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 791.036, Government Code, is amended to |
|---|
| 9 | 11 | | read as follows: |
|---|
| 10 | 12 | | Sec. 791.036. REGULATION OF TRAFFIC IN SPECIAL DISTRICTS. |
|---|
| 11 | 13 | | The commissioners court of a county may enter into an interlocal |
|---|
| 12 | 14 | | contract with the board of a special district for the county to: |
|---|
| 13 | 15 | | (1) apply the county's traffic regulations to a public |
|---|
| 14 | 16 | | road in the county that is owned, operated, and maintained by the |
|---|
| 15 | 17 | | district if the commissioners court finds that it is in the county's |
|---|
| 16 | 18 | | interest to regulate traffic on the public road; and |
|---|
| 17 | 19 | | (2) enforce the regulations. |

| 18 | 20 | | SECTION 2. Section 251.151(b), Transportation Code, is |
|---|
| 19 | 21 | | amended to read as follows: |
|---|
| 20 | 22 | | (b) Under the terms of an interlocal contract under Section |
|---|
| 21 | 23 | | 791.036, Government Code, the [The] commissioners court of a county |
|---|
| 22 | 24 | | may: |
|---|
| 23 | 25 | | (1) by order apply the county's traffic regulations to |
|---|
| 24 | 26 | | a public road in the county that is owned, operated, and maintained |
|---|
| 25 | 27 | | by a special district and located wholly or partly in the county; |
|---|
| 26 | 28 | | and |
|---|
| 27 | 29 | | (2) provide for the enforcement of the regulations [if |
|---|
| 28 | 30 | | the commissioners court and the board of the district have entered |
|---|
| 29 | 31 | | into an interlocal contract under Section 791.036, Government |
|---|
| 30 | 32 | | Code]. |
|---|
| 31 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 37 | | Act takes effect September 1, 2019. |
