46 AN ACT
57 relating to the enforcement of traffic regulations on a public road
68 that is owned, operated, and maintained by a special district.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 791.036, Government Code, is amended to
911 read as follows:
1012 Sec. 791.036. REGULATION OF TRAFFIC IN SPECIAL DISTRICTS.
1113 The commissioners court of a county may enter into an interlocal
1214 contract with the board of a special district for the county to:
1315 (1) apply the county's traffic regulations to a public
1416 road in the county that is owned, operated, and maintained by the
1517 district if the commissioners court finds that it is in the county's
1618 interest to regulate traffic on the public road; and
1719 (2) enforce the regulations.
1820 SECTION 2. Section 251.151(b), Transportation Code, is
1921 amended to read as follows:
2022 (b) Under the terms of an interlocal contract under Section
2123 791.036, Government Code, the [The] commissioners court of a county
2224 may:
2325 (1) by order apply the county's traffic regulations to
2426 a public road in the county that is owned, operated, and maintained
2527 by a special district and located wholly or partly in the county;
2628 and
2729 (2) provide for the enforcement of the regulations [if
2830 the commissioners court and the board of the district have entered
2931 into an interlocal contract under Section 791.036, Government
3032 Code].
3133 SECTION 3. This Act takes effect immediately if it receives
3234 a vote of two-thirds of all the members elected to each house, as
3335 provided by Section 39, Article III, Texas Constitution. If this
3436 Act does not receive the vote necessary for immediate effect, this
3537 Act takes effect September 1, 2019.
