44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of a pilot program to create
77 additional housing for certain individuals with an intellectual or
88 developmental disability through a Medicaid waiver program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.02441 to read as follows:
1212 Sec. 531.02441. PILOT PROGRAM. (a) The commission shall
1313 establish and conduct a pilot program for a period of ten years that
1414 provides funding to a community non-profit corporation to create
1515 additional housing in this state for not less than 100 individuals
1616 with an intellectual or developmental disability through the home
1717 and community-based services (HCS) waiver program.
1818 (b) The community non-profit corporation funded under this
1919 section must:
2020 (1) be in a county with a population between 900,000
2121 and 1.5 million that is located adjacent to a county with a
2222 population of 2.5 million or more; and
2323 (2) have a history of providing services to not less
2424 than 300 individuals with an intellectual or developmental
2525 disability for a period of not less than 10 years.
2626 (c) In establishing the pilot program, the commission shall
2727 set a goal to reduce the number of individuals residing and
2828 receiving services in state supported living centers, as defined by
2929 Section 531.002, Health and Safety Code, to an extent necessary to
3030 offset the costs of the pilot program.
3131 (d) The commission shall use proceeds from general
3232 obligations bonds issued by the Texas Public Finance Authority to
3333 provide funding for the creation of additional housing under the
3434 pilot program.
3535 (e) The community non-profit corporation that is provided
3636 with funding under the pilot program shall prepare and submit an
3737 annual report to the commission that summarizes the results of the
3838 pilot program.
3939 SECTION 2. If before implementing any provision of this Act
4040 a state agency determines that any other waiver or authorization
4141 from a federal agency is necessary for implementation of that
4242 provision, the agency affected by the provision shall request the
4343 waiver or authorization and may delay implementing that provision
4444 until the waiver or authorization is granted.
4545 SECTION 3. This Act takes effect on January 1, 2020, but
4646 only if the constitutional amendment proposed by the 86th
4747 Legislature, Regular Session, 2019, authorizing the issuance of
4848 general obligation bonds for conducting a program to create
4949 additional housing for individuals with an intellectual or
5050 developmental disability is approved by the voters. If that
5151 amendment is not approved by the voters, this Act has no effect.
