66 AN ACT
77 relating to the examination by the commissioner of insurance of
88 certain insurers' network quality and adequacy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 1301.0056(a) and (d), Insurance Code,
1111 are amended to read as follows:
1212 (a) The commissioner shall [may] examine an insurer to
1313 determine the quality and adequacy of a network used by a preferred
1414 provider benefit plan or an exclusive provider benefit plan offered
1515 by the insurer under this chapter. An insurer is subject to a
1616 qualifying examination of the insurer's preferred provider benefit
1717 plans and exclusive provider benefit plans and subsequent quality
1818 of care and network adequacy examinations by the commissioner at
1919 the commissioner's discretion and at least once every two [five]
2020 years. Documentation provided to the commissioner during an
2121 examination conducted under this section is confidential and is not
2222 subject to disclosure as public information under Chapter 552,
2323 Government Code.
2424 (d) The department shall deposit an assessment collected
2525 under this section to the credit of the account described by Section
2626 401.156(a) [Texas Department of Insurance operating account].
2727 Money deposited under this subsection shall be used to pay the
2828 salaries and expenses of examiners and all other expenses relating
2929 to the examination of insurers under this section.
3030 SECTION 2. This Act takes effect September 1, 2019.
