44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to allowing staff who work for or provide counseling under
77 the auspices of a licensed outpatient chemical dependency care
88 facility to provide services in satellite offices or facilities
99 that do not require separate licensures, but operate instead under
1010 the license of the sponsoring organization.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 464.003, Health and Safety Code, is
1313 amended by adding Subdivision 464.003(9) to read as follows:
1414 Section 464.003. EXEMPTIONS. This subchapter does not apply
1515 to:
1616 (1) a facility maintained or operated by the federal
1717 government;
1818 (2) a facility directly operated by the state;
1919 (3) a facility licensed by the department under Chapter 241,
2020 243, 248, 466, or 577;
2121 (4) an educational program for intoxicated drivers;
2222 (5) the individual office of a private, licensed health
2323 practitioner who personally renders private individual or
2424 group services within the scope of the practitioner's
2525 license and in the practitioner's office;
2626 (6) an individual who personally provides counseling or support
2727 services to a person with a chemical dependency but does
2828 not offer or purport to offer a chemical dependency
2929 treatment program;
3030 (7) a 12-step or similar self-help chemical dependency recovery
3131 program:
3232 (A) that does not offer or purport to offer a chemical
3333 dependency treatment program;
3434 (B) that does not change program participants; and
3535 (C) in which program participants may maintain anonymity;
3636 (8) a juvenile justice facility or juvenile justice program, as
3737 defined by Section 261.405, Family Code; or
3838 (9) a satellite office or location in which the person
3939 providing services operating under the auspices of a
4040 licensed outpatient care facility and the services
4141 delivered at the satellite site fall into the scope of the
4242 licensure of the outpatient care facility.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all members election to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2019.
