| 6 | 6 | | relating to the distribution to the Texas Racing Commission of |

| 7 | 7 | | certain money deducted from simulcast pari-mutuel pools. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2028.202(a), Occupations Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) A racetrack association shall distribute from the total |
|---|
| 12 | 12 | | amount deducted as provided by Sections 2028.101 and 2028.152 from |
|---|
| 13 | 13 | | each simulcast pari-mutuel pool and each simulcast cross-species |
|---|
| 14 | 14 | | pari-mutuel pool the following shares: |
|---|
| 15 | 15 | | (1) an amount equal to one percent of each simulcast |
|---|
| 16 | 16 | | pari-mutuel pool to the commission for the administration of this |
|---|
| 17 | 17 | | subtitle [as the amount set aside for this state]; |
|---|
| 18 | 18 | | (2) an amount equal to 1.25 percent of each simulcast |
|---|
| 19 | 19 | | cross-species pari-mutuel pool to the commission for the |
|---|
| 20 | 20 | | administration of this subtitle [as the amount set aside for this |
|---|
| 21 | 21 | | state]; |
|---|
| 22 | 22 | | (3) for a horse racetrack association, an amount equal |
|---|
| 23 | 23 | | to one percent of a multiple two wagering pool or multiple three |
|---|
| 24 | 24 | | wagering pool as the amount set aside for the Texas-bred program to |
|---|
| 25 | 25 | | be used as provided by Section 2028.103; |
|---|
| 26 | 26 | | (4) for a greyhound racetrack association, an amount |
|---|
| 27 | 27 | | equal to one percent of a multiple two wagering pool or a multiple |
|---|
| 28 | 28 | | three wagering pool as the amount set aside for the Texas-bred |
|---|
| 29 | 29 | | program for greyhound races, to be distributed and used in |
|---|
| 30 | 30 | | accordance with commission rules adopted to promote greyhound |
|---|
| 31 | 31 | | breeding in this state; and |
|---|
| 32 | 32 | | (5) the remainder as the amount set aside for purses, |
|---|
| 33 | 33 | | expenses, the sending track, and the receiving location under a |
|---|
| 34 | 34 | | contract approved by the commission between the sending track and |
|---|
| 35 | 35 | | the receiving location. |
|---|
| 36 | 36 | | SECTION 2. (a) The change in law made by this Act applies |
|---|
| 37 | 37 | | to the deduction from a pari-mutuel pool for a race conducted by a |
|---|
| 38 | 38 | | racetrack association on or after the effective date of this Act. |
|---|
| 39 | 39 | | (b) As soon as practicable after the effective date of this |
|---|
| 40 | 40 | | Act, the Texas Racing Commission shall revise existing rules or |
|---|
| 41 | 41 | | adopt new rules as necessary to comply with Section 2028.202(a), |
|---|
| 42 | 42 | | Occupations Code, as amended by this Act. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2019. |
