55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing mental health services and mental health
88 education to public school students at school-based health centers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.051(a), Education Code, is amended to
1111 read as follows:
1212 (a) A school district in this state may, if the district
1313 identifies the need, design a model in accordance with this
1414 subchapter for the delivery of cooperative health care programs for
1515 students and their families and may compete for grants awarded
1616 under this subchapter. The model may provide for the delivery of:
1717 (1) conventional health services;
1818 (2) mental health services; and
1919 (3) disease prevention of emerging health threats that
2020 are specific to the district.
2121 SECTION 2. Section 38.054, Education Code, is amended to
2222 read as follows:
2323 Sec. 38.054. CATEGORIES OF SERVICES. The permissible
2424 categories of services are:
2525 (1) family and home support;
2626 (2) mental health care;
2727 (3) health care, including immunizations;
2828 (4) [(3)] dental health care;
2929 (5) [(4)] health education; and
3030 (6) [(5)] preventive health strategies.
3131 SECTION 3. Section 38.058, Education Code, is amended to
3232 read as follows:
3333 Sec. 38.058. HEALTH EDUCATION AND HEALTH CARE ADVISORY
3434 COUNCIL. (a) The board of trustees of a school district may
3535 establish and appoint members to a local health education and
3636 health care advisory council to make recommendations to the
3737 district on the establishment of school-based health centers to
3838 provide health care services, including mental health services, and
3939 to assist the district in ensuring that local community values are
4040 reflected in the operation of each center and in the provision of
4141 health education and mental health education.
4242 (b) A majority of the members of the council must be parents
4343 of students enrolled in the district. In addition to the appointees
4444 who are parents of students, the board of trustees shall also
4545 appoint at least one person from each of the following groups:
4646 (1) teachers;
4747 (2) school administrators;
4848 (3) licensed health care professionals;
4949 (4) licensed mental health services providers;
5050 (5) the clergy;
5151 (6) [(5)] law enforcement;
5252 (7) [(6)] the business community;
5353 (8) [(7)] senior citizens; and
5454 (9) [(8)] students.
5555 SECTION 4. Section 38.063(c), Education Code, is amended to
5656 read as follows:
5757 (c) All health care programs should be designed to meet the
5858 following goals:
5959 (1) reducing student absenteeism;
6060 (2) increasing a student's ability to meet the
6161 student's academic potential; and
6262 (3) stabilizing the physical and mental well-being of
6363 a student.
6464 SECTION 5. Section 38.064(a), Education Code, is amended to
6565 read as follows:
6666 (a) Based on statistics obtained from every school-based
6767 health center in this state that receives funding through the
6868 Department of State Health Services, the Department of State Health
6969 Services shall issue a biennial report to the legislature about the
7070 relative efficacy of services delivered by the centers during the
7171 preceding two years and any increased academic success of students
7272 at campuses served by those centers, with special emphasis on any:
7373 (1) increased attendance, including attendance
7474 information regarding students with chronic illnesses;
7575 (2) decreased drop-out rates;
7676 (3) improved student health, including improved
7777 mental health;
7878 (4) increased student immunization rates;
7979 (5) increased student participation in preventive
8080 health measures, including routine physical examinations and
8181 checkups conducted in accordance with the Texas Health Steps
8282 program; and
8383 (6) improved performance on student assessment
8484 instruments administered under Subchapter B, Chapter 39.
8585 SECTION 6. The board of trustees of a school district that
8686 has established a local health education and health care advisory
8787 council under Section 38.058, Education Code, shall appoint a
8888 licensed mental health services provider to the council, as
8989 required by the change in law made by this Act, as soon as
9090 practicable and not later than January 1, 2020.
9191 SECTION 7. This Act takes effect immediately if it receives
9292 a vote of two-thirds of all the members elected to each house, as
9393 provided by Section 39, Article III, Texas Constitution. If this
9494 Act does not receive the vote necessary for immediate effect, this
9595 Act takes effect September 1, 2019.
