| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Sections 824.601(b-1) and (f), Government Code, | |
| 10 | 10 | are amended to read as follow: | |
| 11 | 11 | (b-1) Subsection (b) does not apply to a retiree: | |
| 12 | 12 | (1) under Section 824.202 whose effective date of | |
| 13 | 13 | retirement is on or before January 1, 2011; or | |
| 14 | 14 | (2) who commits a minor violation of a provision of | |
| 15 | 15 | this subchapter, including a minor violation of an exception | |
| 16 | 16 | provided by Section 824.602, unless the violation occurs | |
| 17 | 17 | frequently. | |
| 18 | 18 | (f) The system shall [may] adopt rules necessary for | |
| 19 | 19 | administering this subchapter, including rules necessary to | |
| 20 | 20 | implement Subsection (b-1)(2). | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2019. |
