55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the maternal peer support pilot program for perinatal
88 mood disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 32, Health and Safety Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. MATERNAL PEER SUPPORT PILOT PROGRAM
1313 Sec. 32.101. DEFINITION. In this subchapter, "pilot
1414 program" means the maternal peer support pilot program established
1515 under this subchapter.
1616 Sec. 32.102. ESTABLISHMENT OF PILOT PROGRAM. (a) The
1717 commission shall establish and operate the maternal peer support
1818 pilot program to reduce the risk and manage the effects of perinatal
1919 mood disorders in women through the delivery of peer support
2020 services at federally qualified health centers located in the
2121 geographic areas in which the pilot program operates.
2222 (b) The commission shall establish the pilot program in
2323 three counties in this state that:
2424 (1) either:
2525 (A) are within an area designated as a mental
2626 health professional shortage area; or
2727 (B) have high rates of maternal mortality and
2828 morbidity as determined by the commission in consultation with the
2929 Maternal Mortality and Morbidity Task Force established under
3030 Chapter 34; and
3131 (2) include at least one rural county and one county
3232 with a population of at least one million.
3333 Sec. 32.103. OPERATION OF PILOT PROGRAM. (a) In
3434 establishing the pilot program, the commission shall:
3535 (1) develop a strategy for federally qualified health
3636 centers participating in the pilot program and persons responsible
3737 for training to collaborate on the training, certification, and
3838 guidance of peer support specialists;
3939 (2) seek comments regarding best practices for the
4040 design and implementation of the pilot program from relevant
4141 interested persons, including mental health care providers, local
4242 mental health authorities, certified peer support specialists and
4343 affiliated organizations, women's health care providers, and
4444 individuals who have personal experience with perinatal mood
4545 disorders;
4646 (3) develop specialized training to:
4747 (A) identify and treat symptoms of perinatal mood
4848 disorders; and
4949 (B) provide peer support services to pregnant
5050 women and new mothers;
5151 (4) develop a strategy for peer support specialists
5252 participating in the pilot program to provide peer support services
5353 through telemedicine or telehealth services;
5454 (5) collaborate with federally qualified health
5555 centers participating in the pilot program to integrate the
5656 delivery of peer support services with the health care services
5757 provided by the centers to women during pregnancy and within one
5858 year of giving birth;
5959 (6) create a protocol for referring to peer support
6060 services women who are diagnosed as having or identified as being at
6161 risk of developing a perinatal mood disorder;
6262 (7) ensure that services provided by peer support
6363 specialists under the pilot program are within the scope of a
6464 practice of care prescribed by commission rule for peer support
6565 specialists who provide similar services; and
6666 (8) develop a method for collecting data on:
6767 (A) maternal health and mental health outcomes;
6868 and
6969 (B) substance use by women receiving peer support
7070 services through the pilot program.
7171 (b) A peer support specialist who provides peer support
7272 services through the pilot program shall:
7373 (1) provide peer support services to women who:
7474 (A) based on the results of a postpartum
7575 depression screening or other screening tool, are diagnosed as
7676 having or identified as being at risk of developing a perinatal mood
7777 disorder; and
7878 (B) are interested in receiving peer support
7979 services; and
8080 (2) through the use of the specialist's personal
8181 experience with perinatal mood disorders:
8282 (A) provide guidance to the women;
8383 (B) if necessary, advocate for the women to
8484 receive mental health care services or other specialized health
8585 care services; and
8686 (C) provide the women with information on mental
8787 health care resources as necessary.
8888 Sec. 32.104. FUNDING. In addition to money appropriated by
8989 the legislature, the commission may accept gifts, grants, and
9090 donations from any source for the purpose of establishing the pilot
9191 program and compensating peer support specialists under the pilot
9292 program.
9393 Sec. 32.105. REPORT. Not later than January 1, 2021, the
9494 commission shall prepare and submit to the governor, lieutenant
9595 governor, and legislature a written report that:
9696 (1) evaluates the success of the pilot program in
9797 reducing perinatal mood disorders and substance use in women who
9898 received peer support services under the pilot program; and
9999 (2) recommends whether the pilot program should be
100100 continued, expanded, or terminated.
101101 Sec. 32.106. EXPIRATION. This chapter expires September 1,
102102 2023.
103103 SECTION 2. (a) Not later than December 31, 2019, the
104104 executive commissioner of the Health and Human Services Commission
105105 shall adopt rules as necessary to establish the pilot program as
106106 required by Subchapter E, Chapter 32, Health and Safety Code, as
107107 added by this Act.
108108 (b) Not later than June 31, 2020, the Health and Human
109109 Services Commission shall establish the pilot program as required
110110 by Subchapter E, Chapter 32, Health and Safety Code, as added by
111111 this Act.
112112 SECTION 3. This Act takes effect September 1, 2019.
