66 AN ACT
77 relating to the inclusion of school climate in the indicators for
88 evaluating the performance of public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.053(c), Education Code, as amended by
1111 Chapters 807 (H.B. 22), 842 (H.B. 2223), and 1088 (H.B. 3593), Acts
1212 of the 85th Legislature, Regular Session, 2017, is reenacted and
1313 amended to read as follows:
1414 (c) School districts and campuses must be evaluated based on
1515 three domains of indicators of achievement adopted under this
1616 section that include:
1717 (1) in the student achievement domain, indicators of
1818 student achievement that must include:
1919 (A) for evaluating the performance of districts
2020 and campuses generally:
2121 (i) an indicator that accounts for the
2222 results of assessment instruments required under Sections
2323 39.023(a), (c), and (l), as applicable for the district and campus,
2424 including the results of assessment instruments required for
2525 graduation retaken by a student, aggregated across grade levels by
2626 subject area, including:
2727 (a) for the performance standard
2828 determined by the commissioner under Section 39.0241(a), the
2929 percentage of students who performed satisfactorily on the
3030 assessment instruments, aggregated across grade levels by subject
3131 area; and
3232 (b) for the college readiness
3333 performance standard as determined under Section 39.0241, the
3434 percentage of students who performed satisfactorily on the
3535 assessment instruments, aggregated across grade levels by subject
3636 area; and
3737 (ii) an indicator that accounts for the
3838 results of assessment instruments required under Section
3939 39.023(b), as applicable for the district and campus, including the
4040 percentage of students who performed satisfactorily on the
4141 assessment instruments, as determined by the performance standard
4242 adopted by the agency, aggregated across grade levels by subject
4343 area; and
4444 (B) for evaluating the performance of high school
4545 campuses and districts that include high school campuses,
4646 indicators that account for:
4747 (i) students who satisfy the Texas Success
4848 Initiative (TSI) college readiness benchmarks prescribed by the
4949 Texas Higher Education Coordinating Board under Section 51.334 on
5050 an assessment instrument in reading or mathematics designated by
5151 the coordinating board under that section;
5252 (ii) students who satisfy relevant
5353 performance standards on advanced placement tests or similar
5454 assessments;
5555 (iii) students who earn dual course credits
5656 in the dual credit courses;
5757 (iv) students who enlist in the armed
5858 forces of the United States;
5959 (v) students who earn industry
6060 certifications;
6161 (vi) students admitted into postsecondary
6262 industry certification programs that require as a prerequisite for
6363 entrance successful performance at the secondary level;
6464 (vii) students whose successful completion
6565 of a course or courses under Section 28.014 indicates the student's
6666 preparation to enroll and succeed, without remediation, in an
6767 entry-level general education course for a baccalaureate degree or
6868 associate degree;
6969 (viii) students who successfully met
7070 standards on a composite of indicators that through research
7171 indicates the student's preparation to enroll and succeed, without
7272 remediation, in an entry-level general education course for a
7373 baccalaureate degree or associate degree;
7474 (ix) high school graduation rates, computed
7575 in accordance with standards and definitions adopted in compliance
7676 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
7777 subject to the exclusions provided by Subsections (g), (g-1),
7878 (g-2), and (g-3);
7979 (x) students who successfully completed an
8080 OnRamps dual enrollment course; [and]
8181 (xi) [the percentage of] students who
8282 successfully completed a practicum or internship approved by the
8383 State Board of Education; and
8484 (xii) students who are awarded an associate
8585 [associate's] degree;
8686 (2) in the school progress domain, indicators for
8787 effectiveness in promoting student learning, which must include:
8888 (A) for assessment instruments, including
8989 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
9090 percentage of students who met the standard for improvement, as
9191 determined by the commissioner; and
9292 (B) for evaluating relative performance, the
9393 performance of districts and campuses compared to similar districts
9494 or campuses; and
9595 (3) in the closing the gaps domain:
9696 (A) [,] the use of disaggregated data to
9797 demonstrate the differentials among students from different racial
9898 and ethnic groups, socioeconomic backgrounds, and other factors,
9999 including:
100100 (i) [(A)] students formerly receiving
101101 special education services;
102102 (ii) [(B)] students continuously enrolled;
103103 and
104104 (iii) [(C)] students who are mobile; and
105105 (B) the use of local evaluations, as provided by
106106 Section 39.0545, to demonstrate differential performance ratings
107107 among districts and campuses in school climate.
108108 SECTION 2. Subchapter C, Chapter 39, Education Code, is
109109 amended by adding Section 39.0545 to read as follows:
110110 Sec. 39.0545. EVALUATION OF SCHOOL CLIMATE AS COMPONENT OF
111111 OVERALL DISTRICT AND CAMPUS RATING. (a) For purposes of including
112112 the local evaluation of districts and campuses under Section
113113 39.053(c)(3)(B) and assigning an overall rating under Section
114114 39.054, the commissioner by rule shall adopt a method that is based
115115 on recognized research and national standards to evaluate the
116116 school climate of school districts and campuses.
117117 (b) Using the method adopted by the commissioner under
118118 Subsection (a) to evaluate school climate, each school district
119119 shall assign the district and each campus shall assign the campus a
120120 school climate performance rating of exemplary, recognized,
121121 acceptable, or needs improvement.
122122 (c) On or before the date determined by the commissioner by
123123 rule, each school district and campus shall report the school
124124 climate performance rating to the agency for the purpose of
125125 including the rating in evaluating school district and campus
126126 performance and assigning an overall rating under Section 39.054.
127127 SECTION 3. As soon as practicable, the commissioner of
128128 education shall adopt a method to evaluate the school climate of
129129 school districts and campuses as provided by Section 39.0545,
130130 Education Code, as added by this Act.
131131 SECTION 4. To the extent of any conflict, this Act prevails
132132 over another Act of the 86th Legislature, Regular Session, 2019,
133133 relating to nonsubstantive additions to and corrections in enacted
134134 codes.
135135 SECTION 5. This Act applies beginning with the 2019-2020
136136 school year.
137137 SECTION 6. This Act takes effect immediately if it receives
138138 a vote of two-thirds of all the members elected to each house, as
139139 provided by Section 39, Article III, Texas Constitution. If this
140140 Act does not receive the vote necessary for immediate effect, this
141141 Act takes effect September 1, 2019.
