66 AN ACT
77 relating to the use of a Restatement of the Law published by the
88 American Law Institute.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1, Civil Practice and Remedies Code, is
1111 amended by adding Section 1.004 to read as follows:
1212 Sec. 1.004. USE OF RESTATEMENT PROHIBITED. Except as
1313 specifically provided by this code, a Restatement of the Law
1414 published by the American Law Institute shall not be considered in
1515 any action governed by the laws of this state.
1616 SECTION 2. This Act takes effect immediately if it receives
1717 a vote of two-thirds of all the members elected to each house, as
1818 provided by Section 39, Article III, Texas Constitution. If this
1919 Act does not receive the vote necessary for immediate effect, this
2020 Act takes effect September 1, 2019.
