66 AN ACT
77 relating to a presentation by the commissioner of insurance on the
88 National Association of Insurance Commissioners accreditation
99 process and participation in the National Conference of Insurance
1010 Legislators.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 31, Insurance Code, is
1313 amended by adding Section 31.008 to read as follows:
1414 Sec. 31.008. PARTICIPATION IN NATIONAL CONFERENCE OF
1515 INSURANCE LEGISLATORS. The department shall pay annually from
1616 department funds the costs of:
1717 (1) the state's membership in the National Conference
1818 of Insurance Legislators; and
1919 (2) full participation in the National Conference of
2020 Insurance Legislators by the chairs and ranking members of the
2121 standing committees of the senate and the house of representatives
2222 with primary jurisdiction over insurance or finance.
2323 SECTION 2. Subchapter B, Chapter 31, Insurance Code, is
2424 amended by adding Section 31.029 to read as follows:
2525 Sec. 31.029. PRESENTATION ON NATIONAL ASSOCIATION OF
2626 INSURANCE COMMISSIONERS ACCREDITATION PROCESS. (a) Except as
2727 provided by Subsection (e), during the first year of each state
2828 fiscal biennium, the commissioner shall provide to each standing
2929 committee of the senate and the house of representatives with
3030 primary jurisdiction over insurance, or if determined by rules of
3131 those standing committees, each standing committee of the senate
3232 and the house of representatives with primary jurisdiction over
3333 finance, a presentation regarding the accreditation process for the
3434 National Association of Insurance Commissioners.
3535 (b) The presentation must:
3636 (1) provide an overview of the role of delegation of
3737 legislative authority for policy development in the National
3838 Association of Insurance Commissioners accreditation process;
3939 (2) explain how state laws incorporate National
4040 Association of Insurance Commissioners accreditation standards or
4141 incorporate rules, standards, and processes by reference, and
4242 provide citations to those laws;
4343 (3) identify in a separate format each provision of
4444 law that may authorize future changes by the National Association
4545 of Insurance Commissioners to be adopted without additional
4646 authorization by the legislature, highlighting any future
4747 delegation authority in the laws or rules of this state; and
4848 (4) provide an overview of the minimum National
4949 Association of Insurance Commissioners accreditation standards
5050 relating to:
5151 (A) laws and regulations;
5252 (B) regulatory practices and procedures; and
5353 (C) organizations and personnel practices.
5454 (c) The overview presented under Subsection (b)(4) must
5555 include:
5656 (1) summaries of the specific laws and rules that the
5757 accreditation standard specifies;
5858 (2) the intended purpose of each accreditation
5959 standard;
6060 (3) the date that the accreditation standard was
6161 adopted by the National Association of Insurance Commissioners and
6262 the date that the standard was adopted in this state; and
6363 (4) any change to the accreditation standards since
6464 the last presentation to the legislature.
6565 (d) The commissioner may make the presentation at a joint
6666 hearing of the applicable committees under Subsection (a).
6767 (e) Instead of providing the presentation required under
6868 Subsection (a), the department may coordinate with the National
6969 Association of Insurance Commissioners to conduct a training
7070 session that contains the same information required under
7171 Subsection (b) that is specific to the laws of this state during a
7272 National Association of Insurance Commissioners meeting.
7373 (f) If the department exercises the option under Subsection
7474 (e), the department shall pay from funds the costs associated with
7575 registration and reimbursement for reasonable food, travel, and
7676 lodging for two committee members from the standing committee of
7777 the senate with primary jurisdiction over insurance, two committee
7878 members from the standing committee of the house of representatives
7979 with primary jurisdiction over insurance, and one committee member
8080 from the standing committee of each chamber with primary
8181 jurisdiction over appropriations to attend the meeting.
8282 SECTION 3. The commissioner of insurance shall provide the
8383 first presentation required under Section 31.029, Insurance Code,
8484 as added by this Act, not later than September 1, 2020.
8585 SECTION 4. This Act takes effect September 1, 2019.
