11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 31, Insurance Code, is |
---|
13 | 13 | | amended by adding Section 31.008 to read as follows: |
---|
14 | 14 | | Sec. 31.008. PARTICIPATION IN NATIONAL CONFERENCE OF |
---|
15 | 15 | | INSURANCE LEGISLATORS. The department shall pay annually from |
---|
16 | 16 | | department funds the costs of: |
---|
17 | 17 | | (1) the state's membership in the National Conference |
---|
18 | 18 | | of Insurance Legislators; and |
---|
19 | 19 | | (2) full participation in the National Conference of |
---|
20 | 20 | | Insurance Legislators by the chairs and ranking members of the |
---|
21 | 21 | | standing committees of the senate and the house of representatives |
---|
22 | 22 | | with primary jurisdiction over insurance or finance. |
---|
23 | 23 | | SECTION 2. Subchapter B, Chapter 31, Insurance Code, is |
---|
24 | 24 | | amended by adding Section 31.029 to read as follows: |
---|
25 | 25 | | Sec. 31.029. PRESENTATION ON NATIONAL ASSOCIATION OF |
---|
26 | 26 | | INSURANCE COMMISSIONERS ACCREDITATION PROCESS. (a) Except as |
---|
27 | 27 | | provided by Subsection (e), during the first year of each state |
---|
28 | 28 | | fiscal biennium, the commissioner shall provide to each standing |
---|
29 | 29 | | committee of the senate and the house of representatives with |
---|
30 | 30 | | primary jurisdiction over insurance, or if determined by rules of |
---|
31 | 31 | | those standing committees, each standing committee of the senate |
---|
32 | 32 | | and the house of representatives with primary jurisdiction over |
---|
33 | 33 | | finance, a presentation regarding the accreditation process for the |
---|
34 | 34 | | National Association of Insurance Commissioners. |
---|
35 | 35 | | (b) The presentation must: |
---|
36 | 36 | | (1) provide an overview of the role of delegation of |
---|
37 | 37 | | legislative authority for policy development in the National |
---|
38 | 38 | | Association of Insurance Commissioners accreditation process; |
---|
39 | 39 | | (2) explain how state laws incorporate National |
---|
40 | 40 | | Association of Insurance Commissioners accreditation standards or |
---|
41 | 41 | | incorporate rules, standards, and processes by reference, and |
---|
42 | 42 | | provide citations to those laws; |
---|
43 | 43 | | (3) identify in a separate format each provision of |
---|
44 | 44 | | law that may authorize future changes by the National Association |
---|
45 | 45 | | of Insurance Commissioners to be adopted without additional |
---|
46 | 46 | | authorization by the legislature, highlighting any future |
---|
47 | 47 | | delegation authority in the laws or rules of this state; and |
---|
48 | 48 | | (4) provide an overview of the minimum National |
---|
49 | 49 | | Association of Insurance Commissioners accreditation standards |
---|
50 | 50 | | relating to: |
---|
51 | 51 | | (A) laws and regulations; |
---|
52 | 52 | | (B) regulatory practices and procedures; and |
---|
53 | 53 | | (C) organizations and personnel practices. |
---|
54 | 54 | | (c) The overview presented under Subsection (b)(4) must |
---|
55 | 55 | | include: |
---|
56 | 56 | | (1) summaries of the specific laws and rules that the |
---|
57 | 57 | | accreditation standard specifies; |
---|
58 | 58 | | (2) the intended purpose of each accreditation |
---|
59 | 59 | | standard; |
---|
60 | 60 | | (3) the date that the accreditation standard was |
---|
61 | 61 | | adopted by the National Association of Insurance Commissioners and |
---|
62 | 62 | | the date that the standard was adopted in this state; and |
---|
63 | 63 | | (4) any change to the accreditation standards since |
---|
64 | 64 | | the last presentation to the legislature. |
---|
65 | 65 | | (d) The commissioner may make the presentation at a joint |
---|
66 | 66 | | hearing of the applicable committees under Subsection (a). |
---|
67 | 67 | | (e) Instead of providing the presentation required under |
---|
68 | 68 | | Subsection (a), the department may coordinate with the National |
---|
69 | 69 | | Association of Insurance Commissioners to conduct a training |
---|
70 | 70 | | session that contains the same information required under |
---|
71 | 71 | | Subsection (b) that is specific to the laws of this state during a |
---|
72 | 72 | | National Association of Insurance Commissioners meeting. |
---|
73 | 73 | | (f) If the department exercises the option under Subsection |
---|
74 | 74 | | (e), the department shall pay from funds the costs associated with |
---|
75 | 75 | | registration and reimbursement for reasonable food, travel, and |
---|
76 | 76 | | lodging for two committee members from the standing committee of |
---|
77 | 77 | | the senate with primary jurisdiction over insurance, two committee |
---|
78 | 78 | | members from the standing committee of the house of representatives |
---|
79 | 79 | | with primary jurisdiction over insurance, and one committee member |
---|
80 | 80 | | from the standing committee of each chamber with primary |
---|
81 | 81 | | jurisdiction over appropriations to attend the meeting. |
---|
82 | 82 | | SECTION 3. The commissioner of insurance shall provide the |
---|
83 | 83 | | first presentation required under Section 31.029, Insurance Code, |
---|
84 | 84 | | as added by this Act, not later than September 1, 2020. |
---|
85 | 85 | | SECTION 4. This Act takes effect September 1, 2019. |
