49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the authority of a county to require a person to obtain
712 a building permit from the county for certain portable structures.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Subchapter Z, Chapter 233, Local Government
1015 Code, is amended by adding Section 233.902 to read as follows:
1116 Sec. 233.902. PORTABLE STRUCTURE FOR SALE OF SEASONAL
1217 GOODS. Notwithstanding any other law, a county may not require a
1318 building permit to construct, improve, or occupy a structure used
14- for not more than 60 days in a calendar year for the retail sale of
15- goods if the structure is:
19+ for the retail sale of seasonal goods if the structure is:
1620 (1) portable; and
1721 (2) smaller than 500 square feet.
1822 SECTION 2. This Act takes effect immediately if it receives
1923 a vote of two-thirds of all the members elected to each house, as
2024 provided by Section 39, Article III, Texas Constitution. If this
2125 Act does not receive the vote necessary for immediate effect, this
2226 Act takes effect September 1, 2019.
