8 | 13 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 14 | SECTION 1. Subchapter Z, Chapter 233, Local Government | |
10 | 15 | Code, is amended by adding Section 233.902 to read as follows: | |
11 | 16 | Sec. 233.902. PORTABLE STRUCTURE FOR SALE OF SEASONAL | |
12 | 17 | GOODS. Notwithstanding any other law, a county may not require a | |
13 | 18 | building permit to construct, improve, or occupy a structure used | |
14 | - | for not more than 60 days in a calendar year for the retail sale of | |
15 | - | goods if the structure is: | |

16 | 20 | (1) portable; and | |
17 | 21 | (2) smaller than 500 square feet. | |
18 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 23 | a vote of two-thirds of all the members elected to each house, as | |
20 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 25 | Act does not receive the vote necessary for immediate effect, this | |
22 | 26 | Act takes effect September 1, 2019. | |
