7 | 7 | | relating to authorizing county commissioners who hold a license to |
---|
8 | 8 | | carry a handgun to carry the handgun on the premises of a government |
---|
9 | 9 | | court or an office utilized by a court and the form of the handgun |
---|
10 | 10 | | licenses issued to county commissioners. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 411.179(c), Government Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (c) In adopting the form of the license under Subsection |
---|
15 | 15 | | (a), the department shall establish a procedure for the license of a |
---|
16 | 16 | | qualified handgun instructor or of the attorney general or a judge, |
---|
17 | 17 | | justice, United States attorney, assistant United States attorney, |
---|
18 | 18 | | assistant attorney general, prosecuting attorney, [or] assistant |
---|
19 | 19 | | prosecuting attorney, or county commissioner, as described by |
---|
20 | 20 | | Section 46.15(a)(4), (6), or (7) or (h), Penal Code, to indicate on |
---|
21 | 21 | | the license the license holder's status as a qualified handgun |
---|
22 | 22 | | instructor or as the attorney general or a judge, justice, United |
---|
23 | 23 | | States attorney, assistant United States attorney, assistant |
---|
24 | 24 | | attorney general, district attorney, criminal district attorney, |
---|
25 | 25 | | [or] county attorney, or county commissioner. In establishing the |
---|
26 | 26 | | procedure, the department shall require sufficient documentary |
---|
27 | 27 | | evidence to establish the license holder's status under this |
---|
28 | 28 | | subsection. |

29 | 29 | | SECTION 2. Section 46.15, Penal Code, is amended by adding |
---|
30 | 30 | | Subsection (h) to read as follows: |
---|
31 | 31 | | (h) Section 46.03(a)(3) does not apply to a county |
---|
32 | 32 | | commissioner who: |
---|
33 | 33 | | (1) carries a handgun; and |
---|
34 | 34 | | (2) is licensed to carry the handgun under Subchapter |
---|
35 | 35 | | H, Chapter 411, Government Code. |
---|
36 | 36 | | SECTION 3. Section 411.179(c), Government Code, as amended |
---|
37 | 37 | | by this Act, applies only to an applicant for an original, |
---|
38 | 38 | | duplicate, modified, or renewed license to carry a handgun under |
---|
39 | 39 | | Subchapter H, Chapter 411, Government Code, as amended by this Act, |
---|
40 | 40 | | who submits the application on or after the effective date of this |
---|
41 | 41 | | Act. |
---|
42 | 42 | | SECTION 4. Section 46.15, Penal Code, as amended by this |
---|
43 | 43 | | Act, applies only to an offense committed on or after the effective |
---|
44 | 44 | | date of this Act. An offense committed before the effective date of |
---|
45 | 45 | | this Act is governed by the law in effect on the date the offense was |
---|
46 | 46 | | committed, and the former law is continued in effect for that |
---|
47 | 47 | | purpose. For purposes of this section, an offense was committed |
---|
48 | 48 | | before the effective date of this Act if any element of the offense |
---|
49 | 49 | | was committed before that date. |
---|
50 | 50 | | SECTION 5. This Act takes effect September 1, 2019. |
