66 AN ACT
77 relating to authorizing county commissioners who hold a license to
88 carry a handgun to carry the handgun on the premises of a government
99 court or an office utilized by a court and the form of the handgun
1010 licenses issued to county commissioners.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 411.179(c), Government Code, is amended
1313 to read as follows:
1414 (c) In adopting the form of the license under Subsection
1515 (a), the department shall establish a procedure for the license of a
1616 qualified handgun instructor or of the attorney general or a judge,
1717 justice, United States attorney, assistant United States attorney,
1818 assistant attorney general, prosecuting attorney, [or] assistant
1919 prosecuting attorney, or county commissioner, as described by
2020 Section 46.15(a)(4), (6), or (7) or (h), Penal Code, to indicate on
2121 the license the license holder's status as a qualified handgun
2222 instructor or as the attorney general or a judge, justice, United
2323 States attorney, assistant United States attorney, assistant
2424 attorney general, district attorney, criminal district attorney,
2525 [or] county attorney, or county commissioner. In establishing the
2626 procedure, the department shall require sufficient documentary
2727 evidence to establish the license holder's status under this
2828 subsection.
2929 SECTION 2. Section 46.15, Penal Code, is amended by adding
3030 Subsection (h) to read as follows:
3131 (h) Section 46.03(a)(3) does not apply to a county
3232 commissioner who:
3333 (1) carries a handgun; and
3434 (2) is licensed to carry the handgun under Subchapter
3535 H, Chapter 411, Government Code.
3636 SECTION 3. Section 411.179(c), Government Code, as amended
3737 by this Act, applies only to an applicant for an original,
3838 duplicate, modified, or renewed license to carry a handgun under
3939 Subchapter H, Chapter 411, Government Code, as amended by this Act,
4040 who submits the application on or after the effective date of this
4141 Act.
4242 SECTION 4. Section 46.15, Penal Code, as amended by this
4343 Act, applies only to an offense committed on or after the effective
4444 date of this Act. An offense committed before the effective date of
4545 this Act is governed by the law in effect on the date the offense was
4646 committed, and the former law is continued in effect for that
4747 purpose. For purposes of this section, an offense was committed
4848 before the effective date of this Act if any element of the offense
4949 was committed before that date.
5050 SECTION 5. This Act takes effect September 1, 2019.
