| 9 | 9 | SECTION 1. Sections 38.006, Education Code, is amended by | |
| 10 | 10 | adding subsection (c) and (d) to read as follows: | |
| 11 | 11 | (c) By November first of every even numbered year, the Texas | |
| 12 | 12 | Education Agency shall provide a report to the legislature on the | |
| 13 | 13 | use of E-cigarettes on school property. | |
| 14 | 14 | (1) The report shall include: | |
| 15 | 15 | (i) a compilation of reports provided by | |
| 16 | 16 | each independent school district on their policies on | |
| 17 | 17 | the use of E-cigarettes, complaints raised on | |
| 18 | 18 | instances of violations of their polices, and actual | |
| 19 | 19 | violations of their policies; and | |
| 20 | 20 | (ii) the number of reports to the Texas | |
| 21 | 21 | Education Agency on violations of school policies on | |
| 22 | 22 | the use of E-cigarettes. | |
| 23 | 23 | (d) The Texas Education Agency shall investigate any | |
| 24 | 24 | complaints brought to the agency regarding instances of violations | |
| 25 | 25 | of school policy on the use of E-cigarettes. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2019. |
