|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 130.063(a) and (c), Education Code, are |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 130.063. EXTENSION OF JUNIOR COLLEGE DISTRICT |
|---|
| 12 | 12 | | BOUNDARIES. (a) Subject to Subsections (b) and (c), territory may |
|---|
| 13 | 13 | | be annexed to a junior college district by contract under Section |
|---|
| 14 | 14 | | 130.064 or election under Section 130.065, if the territory: |
|---|
| 15 | 15 | | (1) is contiguous to the annexing junior college |
|---|
| 16 | 16 | | district; [or] |
|---|
| 17 | 17 | | (2) is located in the service area of the annexing |
|---|
| 18 | 18 | | district established under Subchapter J; or |
|---|
| 19 | 19 | | (3) is located within 60 miles of the annexing |
|---|
| 20 | 20 | | district boundaries. |
|---|
| 21 | 21 | | (c) A junior college district may conduct an annexation |
|---|
| 22 | 22 | | election to [not] annex territory under this section that is |
|---|
| 23 | 23 | | included in the service area of another junior college district, |
|---|
| 24 | 24 | | provided that the territory is not included in the boundaries of |
|---|
| 25 | 25 | | another junior college district. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2019. |
