| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 166, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 166.0465 to read as follows: |
|---|
| 11 | 11 | | Sec. 166.0465. ETHICS OR MEDICAL COMMITTEE POLICIES ON |
|---|
| 12 | 12 | | CONFLICTS OF INTEREST AND DISCRIMINATION. Each health care |
|---|
| 13 | 13 | | facility that provides review by an ethics or medical committee |
|---|
| 14 | 14 | | under Section 166.046 shall adopt and implement: |
|---|
| 15 | 15 | | (1) a policy to prevent financial and health care |
|---|
| 16 | 16 | | professional conflicts of interest that may arise during a review |
|---|
| 17 | 17 | | under that section; and |
|---|
| 18 | 18 | | (2) a policy to prohibit consideration of a patient's |
|---|
| 19 | 19 | | permanent physical or mental disability during a review under that |
|---|
| 20 | 20 | | section unless the disability is relevant in determining whether a |
|---|
| 21 | 21 | | medical or surgical intervention is medically appropriate. |
|---|
| 22 | 22 | | SECTION 2. (a) A health care facility shall adopt the |
|---|
| 23 | 23 | | policies required by Section 166.0465, Health and Safety Code, as |
|---|
| 24 | 24 | | added by this Act, not later than April 1, 2020. |
|---|
| 25 | 25 | | (b) The policies adopted under Section 166.0465, Health and |
|---|
| 26 | 26 | | Safety Code, as added by this Act, apply to an ethics or medical |
|---|
| 27 | 27 | | committee review conducted on or after April 1, 2020. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2019. |
